POLICE <br /> INTEGRITY • PROFESSIONALISM • HONOR <br /> Consent Agreement for Mutual Aid Peace Officers Powers <br /> Pursuant to the provisions enumerated in RCW 10.93.070(1), the City of Everett Police <br /> Department desires to take full advantage of the Washington Mutual Aid Peace Officers <br /> Powers Act and provide general authority to the City of Mukilteo Police Department to <br /> enforce the traffic and criminal laws of this state, and the criminal codes and infractions <br /> of the City of Everett. <br /> Now, therefore, the parties agree as follows: <br /> 1. Pursuant to the provisions of RCW 10.93.070(1), written consent is hereby given by <br /> the City of Everett Chief of Police to all general authority Washington peace officers <br /> (as defined in RCW 10.93.010(3)) employed by the City of Mukilteo, to enforce <br /> traffic and criminal laws of the State of Washington, and to enforce all criminal and <br /> infraction codes of the City of Everett, within the territorial jurisdiction of the City of <br /> Everett. <br /> 2. The circumstances surrounding any actual exercise of peace officer authority <br /> pursuant to this agreement and RCW 10.93 shall be timely reported after the fact, to <br /> the Everett Police Department, and shall be subject to any reasonable reporting <br /> procedure which may be established by the two law enforcement agencies. <br /> 3. Any liability or claim of liability which arises out of the exercise or alleged exercise of <br /> authority by an officer acting within the course and scope of the officer's duties as a <br /> peace officer under this Agreement and Chapter 10.93 RCW is the responsibility of <br /> the primary commissioning agency as defined in RCW 10.93.020(8) (the Mukilteo <br /> Police Department), unless the officer acts under the direction and control of <br /> another agency. <br /> 4. This consent agreement can be revoked by either party on three-days written notice. <br /> It can be amended by mutual agreement of the parties.
