<br /> AN ORDINANCE providing for the vacation
<br /> of a portion of the 109th Street cul-de-sac.
<br /> WHEREAS, the City Council of the City of Everett, did by Resolution
<br /> Noo1Q3e , duly adopt and fix the 9th day of December, 1987, at 8:30 a.m. , as
<br /> the date for public hearing; and
<br /> WHEREAS, due and legal notice of the time and place of said hearing and
<br /> determination of said resolution has been given by the City Clerk in the
<br /> manner prescribed by law; and
<br /> WHEREAS, at the time and place fixed for hearing, favorable statements
<br /> and objections to the vacating of the herein described street were heard and
<br /> discussed; and
<br /> WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the
<br /> street which is vacated; and
<br /> WHEREAS, the City Council finds that it would not vacate the street
<br /> could it not retain an easement; and
<br /> WHEREAS, it now appears to the City Council of the City of Everett that
<br /> the said street resolved to be vacated should be vacated pursuant to the terms
<br /> and conditions of this ordinance;
<br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> Section 1: That the following described right-of-way:
<br /> Commencing at the Southwest corner of Lot 47, Broadway Farms No. 2, according
<br /> to the plat thereof recorded in Volume 13 of Plats, page 93, Records of
<br /> Snohomish County, Washington; THENCE, S. 88040'15" E. , along the South line
<br /> of said Lot 47, for 304.69 feet to the TRUE POINT OF BEGINNING; THENCE,
<br /> N. 01019'45"E. for 20.00 feet; THENCE, S. 88040'15" E. for 50.00 feet to
<br /> a point of curve; THENCE, Easterly, along a 50.00 foot radius curve concave
<br /> Southerly, for an arc length of 27.96 feet, consuming a central angle of
<br /> 32002'17", to a point of intersection with another curve concave Southerly
<br /> having a radius point which bears S. 11011'48" E. , 530.00 feet distant;
<br /> THENCE, Westerly, along said curve, for 21.76 feet, consuming a central angle
<br /> of 2021'07" to a point of reverse curvature; THENCE, Westerly along a curve
<br /> concave Northerly whose radius point bears N. 13032'55" W. , 215.73 feet
<br /> distant, for 56.02 feet, consuming a central angle of 14052'41" to the TRUE
<br /> POINT OF BEGINNING;
<br /> TOGETHERWITH,
<br /> Commencing at the Northwest corner of Lot 50, Broadway Farms No. 2 , according
<br /> to the plat thereof recorded in Volume 13 of Plats, page 93, Records of
<br /> Snohomish County, Washington; THENCE, S. 88040'15" E. , along the North line
<br /> of said Lot 50, for 303.30 feet to the TRUE POINT OF BEGINNING; THENCE,
<br /> S. 01019'45" W. for 20.00 feet; THENCE, S. 88040'15" E. for 50.00 feet to
<br /> a point of curve; THENCE, Easterly and Northeasterly, along a 50.00 foot
<br /> radius curve concave to the Northwest, for an arc length of 63.92 feet,
<br /> consuming a central angle of 73014'45" to a point of intersection with a
<br /> 470.00 foot radius curve concave Southerly, whose radius point bears
<br /> S. 10009'26" E. ; THENCE, Westerly, along said curve, for 27.82 feet,
<br /> consuming a central angle of 3023'29", to a point of reverse curvature;
<br /> THENCE, Westerly, along a 275.73 foot radius curve concave Northerly whose
<br /> radius point bears N. 13032'55" W. , an arc distance of 71.60 feet, consuming
<br /> a central angle of 14052'40", to the TRUE POINT OF BEGINNING.
<br /> be and the same is hereby vacated pursuant to the conditions set forth in this
<br /> ordinance.
