• • • 1 ORDINANCE NO. / / qz. 2 AN ORDINANCE providing for the licensing of public places of adult 3 entertainment and amending Ordinance No. 295-74 by the addition of a new chapter and repealing Article 18 of Ordinance No. 4 1145-85. 5 6 THE CITY OF EVERETT DOES ORDAIN: 7 Section 1: Ordinance No. 295-74 is hereby amended by the addition of a new 8 chapter regulating public places of adult entertainment to be entitled "Public Places of 9 Adult Entertainment" which chapter shall read as follows: 10 A. Preamble. 11 This chapter is intended to protect the general public health, 12 safety and welfare of the citizenry of the City of Everett through the regulation of the operations of public places of adult entertainment. The 13 regulations set forth herein are intended to prevent health and safety problems in and around public places of adult entertainment and to 14 prevent dangerous and unlawful conduct in and around public places of adult entertainment. 15 B. Definition. 16 For the purpose of this chapter the words and phrases used herein, 17 unless the context otherwise indicates, shall have the following meanings: 18 1. "Clerk" means the City Clerk of the City of Everett who is designated by the Mayor as licensing official under this chapter. It 19 also includes his/her designee. 20 2. "Public place of adult entertainment" means any exhibition or dance constituting "adult entertainment" as defined in Section 6 21 which is for the use or benefit of a member or members of the adult public, or advertised for the use or benefit of a member of 22 the adult public, held, conducted, operated or maintained for a profit, direct or indirect. 23 3. "Manager" means any person who manages, directs, administers, or 24 is in charge of, the affairs and/or the conduct of any portion of any activity involving adult entertainment occurring at any place 25 offering adult entertainment. 26 4. "Entertainer" means any person who provides adult entertainment within a public place of adult entertainment as defined in this 27 section whether or not a fee is charged or accepted for entertain- 28 ment. 5. "Entertainment" means any exhibition or dance of any type, 29 pantomime, modeling or any other performance. 30 6. "Adult entertainment" means any exhibition or dance of any type conducted in premises where such exhibition or dance involves the 31 exposure to view of any portion of the breast below the top of the areola or any portion of the pubic hair, anus, buttocks, vulva and/or 32 genitals.
