D1q-* <br /> AN ORDINANCE revising the legal description of <br /> the easement retained within the vacation of 39th <br /> Street, from the alley west of Smith Avenue, westerly <br /> from the "41st Street to Smith Avenue Overpass", and <br /> amending Section 4 of Ordinance No. 981-83. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 4 of Ordinance No. 981-83 which reads as follows: <br /> That the City of Everett hereby retains an easement to construct, <br /> reconstruct, operate, maintain, repair and replace all utilities under, over and across <br /> the following described legal description: <br /> An easement 15 feet in width and being 7.5 feet on each side of the <br /> following described centerline: <br /> Beginning at the Northeast corner of the West one-half of Block 33, J.S. <br /> Sines Acre Tracts according to the plat thereof recorded in Volume 4 of <br /> Plats, page 11, records of Snohomish County, Washington, said point also <br /> being on the West line of the alley within said plat; thence North along the <br /> Northerly projected West line of said alley, a distance of 27 feet, more or <br /> less, to the true point of beginning; thence Westerly parallel to the North <br /> line of said Block 33, a distance of 55 feet, more or less; thence angle 11- <br /> %o to the right for a distance of 59 feet, more or less, to a point of <br /> intersection with the Westerly line of the above-described vacation and the <br /> terminus of this description. <br /> The above legal description is intended to describe the center line of the <br /> existing City of Everett waterline. <br /> The City of Everett further retains the right to grant to public and private <br /> utilities the right to construct, reconstruct, operate, maintain, repair and replace <br /> existing or proposed utility lines including, but not limited to, telephone, gas and <br /> electrical, under, over and across the property above described, together with the <br /> following described parcel: <br /> The South 15 feet of the North 76 feet of the East 22 feet of that portion of <br /> 39th Street in Everett, Washington, lying east of SR 5 41st Street <br /> Interchange and west of a line which is parallel and 143.7 feet west of the <br /> west line of Smith Avenue situated in the Southeast quarter of the <br /> Southwest quarter of Section 29, Township 29 North, Range 5 East, W.M. <br /> The City further retains the right of access across adjoining properties for the <br /> purposes set forth herein. <br /> Is hereby amended to read hereafter as follows: <br /> Section 4: That the City of Everett hereby retains an easement to <br /> reconstruct, operate, maintain, repair and replace all utilities under, over and across <br /> the following described parcel: <br /> The South 15.0 feet of the North 21.0 feet of 39th Street, as described <br /> within Section 1. <br />
