ORDINANCE NO. /48/ <br /> AN ORDINANCE providing for the vacation of <br /> a portion of Lynnewood Drive lying Southerly <br /> of intersection with Belvedere Avenue. <br /> WHEREAS, the City Council of the City of Everett did, by Resolution 2430, <br /> duly adopt and fix the 20th day of June, 1984, at 7:00 p.m., as the date for public <br /> hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, favorable statements <br /> and objections to the vacating of the herein described street were heard and <br /> discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that <br /> the said street resolved to be vacated should be vacated pursuant to the terms and <br /> conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the following described right-of-way: <br /> That portion of Lynnewood Drive shown on the Replat of Lot "X", <br /> Darlington, according to the plat thereof as recorded in Volume 9 of Plats on <br /> page 50, records of Snohomish County, Washington, and that portion of a <br /> deeded right-of-way across Lots 21 and 22 of said plat described as follows: <br /> Beginning at the southeast corner of Lot 20 of said plat; thence S 89°28' E <br /> along the south line of said plat for 35.60 feet; thence N 22°39'31" W for <br /> 10.48 feet; thence N 40°46'22" W along the easterly line of said Lynnewood <br /> Drive for 89.73 feet to the south line of the north 25.0 feet of said Lot 21, <br /> being the south line of a deeded road right-gf-way; thence S 89 28' E along <br /> said south line for 30.35 feet; thence N 22 39'31" W for 54.40 feet to the <br /> north line of the south 25.0 feet of said Lot 22, being the north line of a <br /> deeded right-of-way; thence N 89°28' W along said north line for 41.55 feet <br /> to the easterly line of said Lynnewood Drive; thence N 1°07'12" W for 104.02 <br /> feet; thence N 22°39'31" for 81.71 feet to the westerly line of said <br /> Lynnewood Drive; thence S 1°07'12" E along said westsrly line for 204.17 <br /> feet to the northeast corner of said Lot 20; thence S 40 46'22" E along said <br /> westerly line for 135.84 feet to the point of beginning. <br /> be and the same is hereby vacated pursuant to the conditions set forth in this <br /> ordinance. <br /> Section 2: That the City of Everett shall not be responsible nor liable for <br /> storm drainage runoff resulting from existing drainage patterns as established on <br /> City rights-of-way that may currently, or in the future, go over, under, or across <br /> the above-described street vacation. <br />
