ORDINANCE NO. /48/ AN ORDINANCE providing for the vacation of a portion of Lynnewood Drive lying Southerly of intersection with Belvedere Avenue. WHEREAS, the City Council of the City of Everett did, by Resolution 2430, duly adopt and fix the 20th day of June, 1984, at 7:00 p.m., as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: That portion of Lynnewood Drive shown on the Replat of Lot "X", Darlington, according to the plat thereof as recorded in Volume 9 of Plats on page 50, records of Snohomish County, Washington, and that portion of a deeded right-of-way across Lots 21 and 22 of said plat described as follows: Beginning at the southeast corner of Lot 20 of said plat; thence S 89°28' E along the south line of said plat for 35.60 feet; thence N 22°39'31" W for 10.48 feet; thence N 40°46'22" W along the easterly line of said Lynnewood Drive for 89.73 feet to the south line of the north 25.0 feet of said Lot 21, being the south line of a deeded road right-gf-way; thence S 89 28' E along said south line for 30.35 feet; thence N 22 39'31" W for 54.40 feet to the north line of the south 25.0 feet of said Lot 22, being the north line of a deeded right-of-way; thence N 89°28' W along said north line for 41.55 feet to the easterly line of said Lynnewood Drive; thence N 1°07'12" W for 104.02 feet; thence N 22°39'31" for 81.71 feet to the westerly line of said Lynnewood Drive; thence S 1°07'12" E along said westsrly line for 204.17 feet to the northeast corner of said Lot 20; thence S 40 46'22" E along said westerly line for 135.84 feet to the point of beginning. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. Section 2: That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may currently, or in the future, go over, under, or across the above-described street vacation.
