1 ORDINANCE NO. /V z/Y-,P4 <br /> 2 <br /> AN ORDINANCE regulating the temporary use of City rights-of-way, <br /> 3 providing for an annual fee for the temporary use of City <br /> rights-of-way, and delegating to the Public Works Department the <br /> 4 responsibility of issuing permits for the temporary use of City <br /> right-of-way and repealing Sections 20 and 21 of Ordinance <br /> 5 No. 2513. <br /> 6 <br /> 7 WHEREAS, City Council finds that it should regulate the temporary use of City <br /> 8 right-of-way; and <br /> 9 WHEREAS, City Council finds that the City should issue an annual permit for <br /> 10 temporary use of City right-of-way including streets, alleys and sidewalks and charge a <br /> 11 fee for such use; and <br /> 12 WHEREAS, City Council finds that the annual permit fee should be based upon a <br /> 13 fair rental value which is competitive in the open real estate market; and <br /> 14 WHEREAS, City Council finds that the fair rental value is influenced by land use <br /> 15 (zoning) as well as the income producing nature of the property; and <br /> 16 WHEREAS, City Council finds that the issuance of the annual permits is an <br /> 17 administrative matter; <br /> 18 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN; <br /> 19 Section 1: Temporary Use of City Right-of-Way - Permit. Special <br /> 20 temporary use of City right-of-way including streets, alleys and sidewalks within the <br /> 21 City, where such use is nonexclusive and will not interfere with public convenience, <br /> 22 may be granted by the Public Works Department; provided, however, Council shall set <br /> 23 the annual permit rates to be charged by the Public Works Department. <br /> 24 Section 2: Special, Private Use of City Property - Permit. No special or <br /> 25 private use shall be made of any City right-of-way including but not limited to streets, <br /> 26 alleys and sidewalks by any person, entity or corporation without first having secured <br /> 27 from the Public Works Department the requisite permit and having paid the permit fee. <br /> 28 Section 3: Annual Permit Fee. All permit fees for the temporary use of <br /> 29 City right-of-way including streets, alleys and sidewalks shall be based upon the <br /> 30 following rate schedules: <br /> 31 <br /> 32 <br />
