1 ORDINANCE NO. f3 C 83 <br /> 2 <br /> 3 AN ORDINANCE authorizing the condemnation of real property for the <br /> construction of certain street improvements in the area of Casino <br /> 4 Road for Casino Road L.I.D. #709 <br /> 5 <br /> 6 WHEREAS, the City Council of the City of Everett finds as follows: <br /> 7 1. Resolution No. 1964 and Ordinance No. 812-81 of the City of Everett <br /> 8 have ordered the construction of certain street improvements and appurtenances to <br /> 9 serve the area of Casino Road between Airport Road and Evergreen Way, including <br /> 10 portions of Hardeson Road (5th Avenue W.) and Evergreen Way in the City of Everett as <br /> 11 illustrated in Exhibit "A," attached hereto and incorporated herein by reference, which <br /> 12 improvements include acquisition of real property, property easements and slope <br /> 13 agreements; and <br /> 14 2. Said Resolution No. 1964 and Ordinance No. 812-81 have established an <br /> 15 L.I.D. to finance part of the costs of said improvements; and <br /> 16 3. Pursuant to said resolution and ordinance, the City's Public Works <br /> 17 Department has designed said street improvements and appurtenances and has estab- <br /> 18 lished and designed the route for said street improvements and appurtenances; and <br /> 19 4. Further, pursuant to said resolution and ordinance, the City has engaged <br /> 20 PAC West Land and Field Services to assist City staff in acquiring property, property <br /> 21 easements, and slope agreements for said street improvement by negotiation with <br /> 22 property owners along the route established by the design of the City's Public Works <br /> 23 Department; and <br /> 24 5. The City has been successful in acquiring the necessary property, property <br /> 25 easements, and slope agreements along the route established for the street improve- <br /> 26 ments with the exception of the property described in Exhibit "B" attached hereto and <br /> 27 incorporated herein by reference; and <br /> 28 6. The public interests of the City of Everett require that the property <br /> 29 shown in Exhibit "B," or portions thereof, be acquired for permanent public use for <br /> 30 street and municipal purposes for the citizens of Everett. <br /> 31 <br /> 32 <br />
