• • <br /> • <br /> 1 ORDINANCE NO. 90 - g . <br /> 2 <br /> AN ORDINANCE amending the City's parking ordinances, Section 16 of <br /> 3 Ordinance No. 470-77 and Section 1 of Ordinance No. 566-78, <br /> clarifying the application of the civil penalty as well as the method <br /> 4 of calculating the civil penalty for all parking violations. <br /> 5 <br /> 6 WHEREAS, the City Council finds that vehicles which park in violation of City <br /> 7 parking ordinances obstruct the designated and intended use of such parking spaces by <br /> 8 the general public and thus constitute a public nuisance; and <br /> 9 WHEREAS, the City Council finds that the penalty amount of $20 should be <br /> 10 added to the fine amount to obtain the civil penalty amount for all parking violations; <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1: That Section 16 of Ordinance No. 470-77 as amended by Section 1 <br /> 13 of Ordinance No. 566-78 reads as follows: <br /> 14 <br /> Section 16: Parking Violations Constituting a Public Nuisance - <br /> 15 Abatement <br /> 16 The City Council finds and declares that any vehicle repeatedly parked in <br /> parking spaces beyond the time established in the parking zone, or the <br /> 17 time authorized by the use of parking meters, obstructs the freedom to <br /> use such parking spaces by the general public for such limited parking <br /> 18 purpose and thus constitutes a public nuisance. Such nuisance shall be <br /> abated as follows: <br /> 19 <br /> 1. Parking fines shall be levied as provided elsewhere in this <br /> 20 municipal code. <br /> 21 2. The owner of record of any vehicle that has been cited for three or <br /> more violations of the parking offenses specified herein in any one <br /> 22 calendar month and/or ten or more violations of the parking <br /> offenses specified herein in any twelve-month period, and said <br /> 23 overtime parking citations have gone unpaid, shall be summoned to <br /> appear before a hearing examiner for an abatement determination: <br /> 24 a. The offense of overtime parking beyond the time established <br /> 25 by either a sign designating the time limit or by a parking <br /> meter; and/or <br /> 26 b. The offense of depositing or causing to be deposited in any <br /> 27 parking meter a coin or coins for the purpose of increasing <br /> or extending the parking time of any vehicle beyond the <br /> 28 legal parking time which has been established; and/or <br /> 29 c. The offense of parking in restricted or prohibited areas of <br /> alleys unless such parking is otherwise authorized pursuant <br /> 30 to an alley service parking permit. <br /> 31 <br /> 32 <br />
