• • • 1 ORDINANCE NO. 90 - g . 2 AN ORDINANCE amending the City's parking ordinances, Section 16 of 3 Ordinance No. 470-77 and Section 1 of Ordinance No. 566-78, clarifying the application of the civil penalty as well as the method 4 of calculating the civil penalty for all parking violations. 5 6 WHEREAS, the City Council finds that vehicles which park in violation of City 7 parking ordinances obstruct the designated and intended use of such parking spaces by 8 the general public and thus constitute a public nuisance; and 9 WHEREAS, the City Council finds that the penalty amount of $20 should be 10 added to the fine amount to obtain the civil penalty amount for all parking violations; 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 12 Section 1: That Section 16 of Ordinance No. 470-77 as amended by Section 1 13 of Ordinance No. 566-78 reads as follows: 14 Section 16: Parking Violations Constituting a Public Nuisance - 15 Abatement 16 The City Council finds and declares that any vehicle repeatedly parked in parking spaces beyond the time established in the parking zone, or the 17 time authorized by the use of parking meters, obstructs the freedom to use such parking spaces by the general public for such limited parking 18 purpose and thus constitutes a public nuisance. Such nuisance shall be abated as follows: 19 1. Parking fines shall be levied as provided elsewhere in this 20 municipal code. 21 2. The owner of record of any vehicle that has been cited for three or more violations of the parking offenses specified herein in any one 22 calendar month and/or ten or more violations of the parking offenses specified herein in any twelve-month period, and said 23 overtime parking citations have gone unpaid, shall be summoned to appear before a hearing examiner for an abatement determination: 24 a. The offense of overtime parking beyond the time established 25 by either a sign designating the time limit or by a parking meter; and/or 26 b. The offense of depositing or causing to be deposited in any 27 parking meter a coin or coins for the purpose of increasing or extending the parking time of any vehicle beyond the 28 legal parking time which has been established; and/or 29 c. The offense of parking in restricted or prohibited areas of alleys unless such parking is otherwise authorized pursuant 30 to an alley service parking permit. 31 32
