ORDINANCE NO. $-{?- F,2 <br /> AN ORDINANCE providing for the vacations <br /> of a portion of Upper Ridge Road lying North <br /> of Haul Road to the Southwesterly right-of-way <br /> margin of Glenwood Avenue. <br /> WHEREAS, the City Council of the City of Everett did by Resolution <br /> No. 1775 duly adopt and fix the 7th day of May, 1980, at 8:30 p.m., as the <br /> date for public hearing; and <br /> WHEREAS, said public hearing was continued until May 21, 1980, and <br /> then again until March 18, 1981; and <br /> WHEREAS, due and legal notice of the time and place of said hearing <br /> and determination of said Resolution has been given by the City Clerk in the <br /> manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing favorable statements <br /> and objections to the vacating of the herein described street were heard and <br /> discussed; and <br /> WHEREAS, after receiving considerable testimony at the May 7 and 21, <br /> 1980, public hearings, City Council appointed a committee consisting of a member <br /> of (1) TAC, (2) Planning Commission, (3) City Council, (4) Planning Department, <br /> (5) Public Works, and (6) an area resident to review the vacation and any and <br /> all alternate realignments to City Council for final consideration. <br /> WHEREAS, City Council finds, as a result of said public hearings and <br /> the recommendation of the above-described committee, that the street vacation <br /> provides a public benefit and that the public interest is served thereby; and <br /> WHEREAS, there were no written protests from property owners abutting <br /> the above-described street; and <br /> WHEREAS, it now appears to the City Council of the City of Everett <br /> that the portion of said streets and alley resolved to be vacated should be vacated; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That portion of Upper Ridge Road lying within the NWY4 <br /> of the NEY4 Section 12 and WY2 of the SWY4 of the SEX, Section 1, all in T. 28 N., <br /> R. 4 E., W.M. and lying South of Glenwood Avenue and North of station 26+68.17 <br /> per Snohomish County engineer's road survey #1552. Said rights of way are more <br /> particularly defined in Quit Claim Deed dated January 11, 1934, and recorded <br /> in Volume 266 of Deeds at Page 147 and Quit Claim Deed dated July 15, 1957, <br />
