ORDINANCE NO.6'O fo'� / 9 AN ORDINANCE providing for the vacation of all that portion of Broadway Cutoff, lying North of SR 526 and West of I-5. WHEREAS, the City Council of the City of Everett did by Resolution No. 1574 duly adopted and fix the 24th day of January, 1979, at 10:00 a.m, for the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearings and determination of said Resolutions has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, it now appears to the City Council of the City of Everett that the portion of said street resolved to be vacated should be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: All that portion of Broadway Cutoff (State Highway 2-J) lying within Sections 7, 8, 17, and 18, Township 28 N, R. 5 E. WM, described as follows: Beginning at the Northwest corner of Section 17, Township 28 N, Range 5 E.W.M.; thence South 89°59'30" East along the North line of said Section 17 a distance of 64.65 feet to the Easterly right-of-way line of State Highway 2-J, the true point of beginning, thence Northeasterly along the Easterly right-of-way line of said Highway 2-J a distance of 351.68 feet to the Westerly right-of-way line of said Highway 2-J; thence South 19°45'46" West a distance of 563.53 feet to the Westerly right-of-way line of said Highway 2-J; thence South 0°22' East a distance of 123.68 feet to the Northerly right-of-way line of SR 526; thence along the arc of a curve to the left having a radius of 300.0 feet an arc length of 83.03 feet to the Easterly right-of- way line of State Highway 2-J; thence Northeasterly along the Easterly right-of-way line of State Highway 2-J to the true point of beginning. be and the same is hereby vacated pursuant to the terms of this Ordinance. Section 2: The City of Everett, its successors or assigns shall not be responsible or liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may now or in the future go over, under or across the above described street vacation.
