• ORDINANCE NO. 7 - 7 7 AN ORDINANCE creating a special construction fund entitled "Railroad Crossing Improvements"; authorizing the construction of railroad crossing signals on California Street, Pacific Avenue, and Bond Street; superseding the previous budgets for Fund 301 Program 604 which were approved by Ordinance Nos. 343-74 and 376-75; and authorizing the appropriation of $258,300 for the construction of these railroad crossing signals. WHEREAS, the City Council of the City of Everett is aware of the hazards to motor vehicles that exist at the street crossings of railroad tracks especially when sight distance is limited; and WHEREAS, the City Council is aware that the railroad crossings on California Street at Terminal Street, on Pacific Avenue at McDougall, and on Bond Street at Terminal Street have been rated as critical by the Washington Transportation and Utilities Commission and considered as priorities for improvement; and WHEREAS, the Federal Highway Act of 1976 did reinstitute the provision of funds for upgrading critical railroad grade crossings and that program provides funding up to ninety (90) percent of construction cost; and WHEREAS, these three railroad grade crossings (i.e, on California, Pacific, and Bond) have been approved for funding under such Federal Highway Act; and WHEREAS, the City of Everett did budget $52,600 for 1975 under Fund 301 Program 604 by Ordinance No. 343-74 and $141,000 for 1976 under Fund 301 Program 604 by Ordinance No. 376-75; and WHEREAS, the time required to obtain FHWA approval of such funds, design by the railroad company of the needed signal and barricade improvements, and purchase and delivery of materials for construction of the needed im- provements has created a need for adjustments to the City appropriation of funds to complete the work; NOW, THEREFORE, BE IT ORDAINED THAT: Section 1: A special construction fund is hereby established as Fund No. 315 entitled "Railroad Crossing Improvements" for the design, construction, and associated activities required to construct the improvements defined in the following sections:
