CITY <br /> CITY OF EVERETT, WASHINGTON <br /> 400- <br /> JOB ORDER CONTRACT <br /> THIS CONTRACT by and between the City of Everett (hereinafter called City) and Burton <br /> Construction Inc. (hereinafter called Contractor). City and Contractor, in consideration of the <br /> mutual covenants hereinafter set forth, agree as follows: <br /> SECTION 1 - WORK <br /> Contractor shall complete all Work as specified or indicated in the Contract Documents. <br /> The Work is generally described as follows: <br /> The Work of this Contract will be set forth in the Detailed Scopes of Work referenced in the <br /> individual Job Orders. The Contractor is required to complete each Detailed Scope of Work for <br /> the Job Order Price within the Job Order Completion Time. <br /> The value of the Job Order Price Proposal shall be calculated by summing the total of the <br /> calculation for each Pre-priced Task (Unit Price x quantity x Adjustment Factor) plus the value <br /> of all Non Pre-priced Tasks. <br /> SECTION 2 — CITY REPRESENTATIVES <br /> 2.1 Project Manager: The City will appoint a Project Manager for each Job Order, who shall be <br /> the City's representative, assume all duties and responsibilities and have the rights and <br /> authority assigned to the Project Manager in the Contract Documents in connection with <br /> completion of the Work in accordance with the Job Order and the Contract Documents. <br /> 2.2 Contract Administrator: The JOC Contract Administrator is designated by the City to <br /> manage the Job Order Contracting program for the City. The Contract Administrator will <br /> oversee the execution of the program on behalf of the City and will provide overall guidance <br /> to the Project Managers and Contractor(s) in the execution of Job Orders. The Contract <br /> Administrator shall intervene in disputes or disagreements between the Project Manager <br /> and the Contractor. The Contract Administrator also may exercise any authority granted to <br /> Project Managers under the Contract Documents with respect to any Job Order at any time. <br /> SECTION 3 - CONTRACT TIME <br /> 3.1 The Base Term of the Contract is two (2) years. <br /> 3.2 There is one (1) bilateral Option Term. Both parties must agree to extend the Contract for <br /> the Option Term. The duration of the Option Term is one year. <br /> 3.3 The City and the Contractor may agree to extend the Option Term. <br />
