1 <br /> ORDINANCE NO. 36 )- -74/ <br /> 2 <br /> 3 <br /> AN ORDINANCE amending Sections 1 and 2 <br /> 4 of Ordinance No. 1765 (E.C.C. Chapter <br /> 6.50) to lower the age tobacco can be <br /> 5 sold to or possessed by minors, from the <br /> age twenty=one to eighteen. <br /> 6 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 7 <br /> Section 1: That Section 1 of Ordinance No. 1765 <br /> 8 (E.C.C. Section 6.50.010) is hereby amended as follows: <br /> 9 Selling tobacco to minors --Unlawful. No person <br /> shall, within the City of Everett, sell, or give, or <br /> 10 permit to be sold or given to any person under the age of <br /> eighteen years, any cigar, cigarette, cigarette paper or <br /> 11 wrapper, or tobacco, in any form. It shall be no defense <br /> to a prosecution for a violation of this section that a <br /> 12 monor acted or was believed by the defendant to have <br /> acted as agent or representative of another. <br /> 13 <br /> Section 2: That Section 2 of Ordinance No. 1765 <br /> 14 (E.C.C. Section 6.50.020) is hereby amended as follows: <br /> 15 Minors--Unlawful to posess tobacco.
