• <br /> ORDINANCE NO. ----7;;? `/ 7 <br /> AN ORDINANCE establishing the ownership, <br /> maintenance and operation of side sewers <br /> within the public right-of-way; amending <br /> 1 Ordinance No. 3735 (E .C .C. 2.20) by the <br /> 2 addition of a new section to said ordinance, <br /> and amending Ordinance No. 3761 (E .C .C . 2.20.230) . <br /> 3 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 4 <br /> Section 1: That a new section be added to Ordinance No. 3735 <br /> 5 <br /> (E .C .C . 2.20) as follows: <br /> 6 <br /> 7 "Side Sewer Ownership and Maintenance <br /> 8 (a) The City of Everett Sewer Department shall subsequent <br /> to approved installation, own, maintain and operate side <br /> 9 sewer connections within the boundaries of the public <br /> right-of-way. The City of Everett Sewer Department shall not be <br /> 10 responsible for maintenance and operation of side sewers outside <br /> 11 the public right-of-way. <br /> 12 (b) In the event a side sewer becomes blocked or stopped, <br /> it shall be the responsibility of the customer whose premises <br /> 13 are attached to the side sewer at his expense to investigate, <br /> by a roto-rooter type equipment or other approved method, <br /> 14 whether the blockage or stoppage is on his premises or <br /> within the public right-of-way. In the event that the <br /> 15 customer has cause to believe the stoppage is within the public <br /> 16 right-of-way, he shall notify the City Sewer Department <br /> which shall investigate and determine the location. The <br /> 17 determination of the Director of Utilities and Engineering, or <br /> his designee, shall be final and conclusive. If it is determined <br /> 18 that the stoppage is within the responsibility of the City, <br /> the bill for services of the contractor shall be paid or <br /> 19 reimbursed by the City Sewer Fund for all work related to <br /> 20 investigation and work on public right-of-way and the City Sewer <br /> Department shall be responsible for the repair of the side sewer within <br /> 21 the public right-of-way, as herein provided, at no cost to the <br /> customer. Payment of said bill or said reimbursement in accordance <br /> 22 with the aforesaid procedure shall be pursuant to the duty established <br /> by this ordinance and a damage claim may be waived. <br /> 23 <br /> 24 (c) Side sewers shall not be installed nor extended in streets <br /> or alleys by customers unless specifically approved by the Sewer <br /> 25 Department prior to such installation and a permit is obtained by <br /> the customer from the City Engineer's Office. <br /> 26 <br /> (d) Side sewer connections to the sewer main will be made <br /> 27 at the owner's expense, under the inspection or supervision of the <br /> Sewer Department." <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
