a <br /> ORDINANCE NO. -> % <br /> A N ORDINANCE establishing procedures and guide- <br /> lines to control the re-segregation of land and <br /> assessments in Local Improvement Districts. <br /> 1 WHEREAS, it has been determined by the City Council that it is in <br /> 2 the best interest of the City of Everett to establish policies, procedures <br /> 3 and regulations to control the segregation of a Local Improvement District <br /> 4 (LID) parcel of land into smaller parts of land, including the assessment <br /> 5 encumbered thereon, and <br /> 6 WHEREAS, RCW 35. 44. 410 provides for such segregations <br /> 7 following the validation of the Ordinance approving and confirming the LID <br /> 8 Assessment Roll, <br /> 9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br /> 10 City of Everett: <br /> 11 Section I: All segregations on parcels of an LID shall be made by <br /> 12 resolution of the City Council; <br /> 13 Section II: All segregations of a parcel of land in a confirmed LID <br /> 14 Assessment Roll shall not be considered until the following requirements <br /> 15 have been met: <br /> 16 1. A written request for segregation of a parcel of land in an <br /> 17 LID has been received by the City Engineer which shall be <br /> 18 accompanied by satisfactory evidence of ownership of <br /> 19 said parcel of land as the City Attorney may direct, and <br /> 20 2. A $40. 00 fee for each new description that will be entered <br /> 21 on the supplemental LID Roll has been received by the <br /> 22 City Treasurer. <br /> 23 3. Assessment installment payments are current on the parcel of <br /> 24 land to be segregated except when otherwise directed by City <br /> 25 Council in a special provision written into the resolution <br /> 26 segregating the parcel of land. <br /> 27 Section III: A supplemental assessment roll of the segregated parts <br /> 28 shall be delivered to the City Treasurer who shall proceed to make the <br /> 29 segregation ordered. <br /> 30 Section IV: A segregation shall not be made unless the City <br /> 31 Council has determined that said segregation is in the best interest of <br /> 32 the City of Everett. <br />
