a ORDINANCE NO. -> % A N ORDINANCE establishing procedures and guide- lines to control the re-segregation of land and assessments in Local Improvement Districts. 1 WHEREAS, it has been determined by the City Council that it is in 2 the best interest of the City of Everett to establish policies, procedures 3 and regulations to control the segregation of a Local Improvement District 4 (LID) parcel of land into smaller parts of land, including the assessment 5 encumbered thereon, and 6 WHEREAS, RCW 35. 44. 410 provides for such segregations 7 following the validation of the Ordinance approving and confirming the LID 8 Assessment Roll, 9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 10 City of Everett: 11 Section I: All segregations on parcels of an LID shall be made by 12 resolution of the City Council; 13 Section II: All segregations of a parcel of land in a confirmed LID 14 Assessment Roll shall not be considered until the following requirements 15 have been met: 16 1. A written request for segregation of a parcel of land in an 17 LID has been received by the City Engineer which shall be 18 accompanied by satisfactory evidence of ownership of 19 said parcel of land as the City Attorney may direct, and 20 2. A $40. 00 fee for each new description that will be entered 21 on the supplemental LID Roll has been received by the 22 City Treasurer. 23 3. Assessment installment payments are current on the parcel of 24 land to be segregated except when otherwise directed by City 25 Council in a special provision written into the resolution 26 segregating the parcel of land. 27 Section III: A supplemental assessment roll of the segregated parts 28 shall be delivered to the City Treasurer who shall proceed to make the 29 segregation ordered. 30 Section IV: A segregation shall not be made unless the City 31 Council has determined that said segregation is in the best interest of 32 the City of Everett.
