ORDINANCE NO. , .2'°; 4% <br /> AN ORDINANCE reducing the license fee for auction <br /> by non-profit charitable organizations for one <br /> auction per year and amending Everett City Code <br /> Section 3.72.030 (Section 152 of Ordinance No. 2513 <br /> as amended by Ordinance No. 2542.) <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN as follows: <br /> Section 1: <br /> That Everett City Code, Section 3.72.030 (Section 152 of Ordinance <br /> No. 2513 as amended by Ordinance No. 2542) be amended to read as follows: <br /> "License-Fee. Any auctioneer selling, attempting to sell, or offering <br /> for sale any jewelry consisting of watches, diamonds, precious stones <br /> and all jewelry of gold, silver or other metal, or anything commonly <br /> known as jewelry; or any clothing, boots, shoes, dry goods, furniture, <br /> household goods of every kind, or any goods, wares or merchandise not <br /> otherwise mentioned herein, and whether of the kind mentioned herein <br /> or not, at public auction in said City shall pay into the City Treasury <br /> a license fee at the rate of Fifty Dollars ($50.00) per day and procure <br /> license therefor upon payment of said license fee; provided, however, <br /> a bona fide charitable non-profit organization shall be allowed to <br /> conduct one auction per year,for a period not exceeding more than <br /> three (3) days, on the following condition: <br /> (a) That the organization is a 'bona fide charitable non-profit <br /> organization' duly existing under the provisions of Chapters <br /> 24.12, 24.20 or 24.28 RCW, or any non-profit corporation duly <br /> existing under the provisions of Chapter 24.03 RCW for Charitable, <br /> benevolent, eleemosynary, educational, civic purposes only. The <br /> fact that contributions to an organization do not qualify for <br /> charitable contribution deduction purposes or that the organization <br /> is not otherwise exempt from payment of federal income taxes <br /> pursuant to the Internal Revenue Code of 1954, as amended, shall <br /> constitute prima facie evidence that the organization is not a <br /> bona fide charitable or non-profit organization for the purposes <br /> of this section." <br /> (b) The auction be conducted by members of a 'bona fide charitable <br /> non-profit organization' and no person other than the organization <br /> conducting said auction shall receive any benefit from such auction. <br /> (c) That the organization pay into the City Treasury a license fee at the <br /> rate of Five ($5.00) Dollars and procure a license therefor upon <br /> payment of said license fee. <br /> (414.4"( <br /> MAYOR <br /> ATTEST: <br /> City Clerk/ <br /> Passed: —7 <br /> Valid: (y - 7- <br /> Published: • 2-4%-j.. <br />
