ORDINANCE NO. AN ORDINANCE regulating the opening of packages containing liquor, the possession and displaying an open con- tainer of liquor and/or consumption of liquor within 1 specified buildings and structures of the park facilities of the City of Everett; amending § 6 of Ordinance 2 No. 3067 and repealing Ordinance No. 3529 (E. C. C. 6. 32. 060) 3 4 THE CITY OF EVERETT DOES ORDAIN: 5 Section 1: Ordinance No. 3067 § 6 (E. C. C. 6. 32. 060) is hereby amended 6 to read as follows: 7 "Except as otherwise permitted in this Chapter or in Chapter 14. 08. 210, it shall be unlawful to open a 8 package containing liquor, to possess or display an open container of liquor, or to consume liquor on the 9 public streets and alleys, or on or in any public property of Everett, a municipal corporation, or on 10 or in any public place where the consumption of intoxicat- ing liquor is prohibited. " 11 Section 2: That a new section should be added to Ordinance No. 3067, 12 designated as Section 6(a) to read as follows: 13 "Upon the conditions hereafter specified, it shall be lawful 14 to open a package containing liquor, to possess or display an open container of liquor or to consume liquor in those 15 Park and Recreation buildings or structures of the City of Everett as specified by Resolution of the City Council. The 16 persons using such premises for the purpose of -opening a package containing liquor, possessing or displaying an 17 open container of liquor and/or consuming liquor must obtain a Banquet and Rental Permit from the superintendent of 18 Park and Recreation of the City of Everett or his designee at the Park and Recreation Offices. Such Banquet and Rental 19 Permit shall be issued on the following conditions: 20 (a) The applicant must produce evidence that it has a Banquet Permit from the Washington State 21 Liquor Control Board. 22 (b) The applicant deposit a sum of $50. 00 to insure proper performance of clean up by the applicant subsequent to 23 the event for which the Banquet and Rental Permit is issued. 24 (c) The applicant must affirm in writing that the attendance 25 at the function for which the Banquet and Rental Permit is issued is not pursuant to a general invitation to the 26 public but pursuant to invitations either to specifically named persons or to actual members of the applicant's 27 organization. 28 (d) The applicant agrees that he or she will save the City of Everett harmless from all losses or damages occasioned 29 to him or her or to any third person or property by reason of any acts or omissions of the applicant or anyone using 30 the premises pursuant to the Banquet and Rental Permit, and he or she shall, after reasonable notice thereof, 31 defend and pay the expense of any suit which may be commenced against the City of Everett by any third 32 person alleging injury or loss by reason of such acts
