ORDINANCE NO. <br /> AN ORDINANCE regulating the opening of packages containing <br /> liquor, the possession and displaying an open con- <br /> tainer of liquor and/or consumption of liquor within <br /> 1 specified buildings and structures of the park facilities <br /> of the City of Everett; amending § 6 of Ordinance <br /> 2 No. 3067 and repealing Ordinance No. 3529 <br /> (E. C. C. 6. 32. 060) <br /> 3 <br /> 4 THE CITY OF EVERETT DOES ORDAIN: <br /> 5 Section 1: Ordinance No. 3067 § 6 (E. C. C. 6. 32. 060) is hereby amended <br /> 6 to read as follows: <br /> 7 "Except as otherwise permitted in this Chapter or in <br /> Chapter 14. 08. 210, it shall be unlawful to open a <br /> 8 package containing liquor, to possess or display an <br /> open container of liquor, or to consume liquor on the <br /> 9 public streets and alleys, or on or in any public <br /> property of Everett, a municipal corporation, or on <br /> 10 or in any public place where the consumption of intoxicat- <br /> ing liquor is prohibited. " <br /> 11 <br /> Section 2: That a new section should be added to Ordinance No. 3067, <br /> 12 <br /> designated as Section 6(a) to read as follows: <br /> 13 <br /> "Upon the conditions hereafter specified, it shall be lawful <br /> 14 to open a package containing liquor, to possess or display <br /> an open container of liquor or to consume liquor in those <br /> 15 Park and Recreation buildings or structures of the City of <br /> Everett as specified by Resolution of the City Council. The <br /> 16 persons using such premises for the purpose of -opening a <br /> package containing liquor, possessing or displaying an <br /> 17 open container of liquor and/or consuming liquor must <br /> obtain a Banquet and Rental Permit from the superintendent of <br /> 18 Park and Recreation of the City of Everett or his designee at <br /> the Park and Recreation Offices. Such Banquet and Rental <br /> 19 Permit shall be issued on the following conditions: <br /> 20 (a) The applicant must produce evidence that it <br /> has a Banquet Permit from the Washington State <br /> 21 Liquor Control Board. <br /> 22 (b) The applicant deposit a sum of $50. 00 to insure proper <br /> performance of clean up by the applicant subsequent to <br /> 23 the event for which the Banquet and Rental Permit is <br /> issued. <br /> 24 <br /> (c) The applicant must affirm in writing that the attendance <br /> 25 at the function for which the Banquet and Rental Permit <br /> is issued is not pursuant to a general invitation to the <br /> 26 public but pursuant to invitations either to specifically <br /> named persons or to actual members of the applicant's <br /> 27 organization. <br /> 28 (d) The applicant agrees that he or she will save the City <br /> of Everett harmless from all losses or damages occasioned <br /> 29 to him or her or to any third person or property by reason <br /> of any acts or omissions of the applicant or anyone using <br /> 30 the premises pursuant to the Banquet and Rental Permit, <br /> and he or she shall, after reasonable notice thereof, <br /> 31 defend and pay the expense of any suit which may be <br /> commenced against the City of Everett by any third <br /> 32 person alleging injury or loss by reason of such acts <br />
