' 1 1 <br /> ORDINANCE NO. 2//- J Z <br /> AN ORDINANCE regulating gambling in the City <br /> of Everett. <br /> 1 <br /> 2 <br /> BE IT ORDAINED BY THE CITY OF EVERETT: <br /> 3 <br /> Section 1: Whoever engages in gambling, or knowingly causes, aids, <br /> 4 <br /> abets, or conspires with another to engage in gambling, shall be guilty of a <br /> 5 <br /> misdemeanor, and punished by a fine of not more than five hundred dollars <br /> 6 <br /> ($500. 00) or imprisonment for a term not exceeding six months, or both <br /> 7 <br /> such fine and imprisonment; PROVIDED, HOWEVER, That this section <br /> 8 <br /> shall not apply to those persons or organizations defined in Section 2(g) when <br /> 9 <br /> such person or organization is engaged in the gambling activities of bingo, <br /> 10 <br /> raffles or amusement games as defined herein. <br /> 11 <br /> Section 2: As used in this ordinance: <br /> 12 <br /> (a) "Contest of chance" means any contest, game, gaming scheme, <br /> 13 or gaming device in which the outcome depends in a material <br /> 14 degree upon an element of chance, notwithstanding that skill of <br /> 15 the contestants may also be a factor therein. <br /> 16 <br /> (b) "Gambling. " A person engages in gambling if he stakes or risks <br /> 17 <br /> something of value upon the outcome of a contest of chance or a <br /> 18 future contingent event not under his control or influence, upon an <br /> 19 agreement or understanding that he or someone else will receive <br /> 20 <br /> something of value in the event of a certain outcome. Gambling <br /> 21 does not include parimutuel betting as authorized by chapter 67. 16 <br /> 22 RCW, bona fide business transactions valid under the law of contract., <br /> 23 including but not limited to, contracts for the purchase or sale at <br /> 24 a future date of securities or commodities, and agreements to <br /> 25 compensate for loss caused by the happening of chance, including, <br /> 26 but not limited to, contracts of indemnity or guarantee and life, <br /> 27 health or accident insurance. <br /> 28 <br /> (c) "Thing of value" means any money or property, any token, object <br /> 29 or article exchangeable for money or property, or any form of <br /> 30 credit or promise, directly or indirectly, contemplating transfer <br /> 31 of money or property or of any interest therein, or involving <br /> 32 extension of a service, entertainment or a privilege of playing at <br />
