QTY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the"License"), between the City of Everett as Grantor <br /> (the"City) and Jansen, Inc., 1215 W. Holly Street, Bellingham, WA 98225 as the Grantee <br /> ("Jansen"),relates to the city owned parking lot located at the northeast corner of 26th Street <br /> and W. Marine View Drive, Everett, WA (the "Property"). <br /> RECITALS <br /> A. Jansen desires to utilize the property for staging of construction materials <br /> for the Everett Downtown Streetscape Project, WO# PW3553 ("Project"). <br /> B. The City is willing to grant Jansen authority to use the City's property upon <br /> certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration, the receipt <br /> and sufficiency of which is hereby expressly acknowledged, the City licenses Jansen to <br /> use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is legally described as LOTS 5 THRU 16, BLOCK 558, <br /> PLAT OF EVERETT DIV. G, as filed for record under Vol. 4, Page 41, records of <br /> Snohomish County, State of Washington. <br /> Section 2. TERM. This License shall be effective beginning at 6:00 A.M.July 1,2019 <br /> and shall expire at midnight on April 30, 2020, unless terminated earlier per Section 7, <br /> below. <br /> Section 3. Intentionally Omitted. <br /> Section 4. AUTHORIZED USE. Jansen may only use the property for the purpose <br /> of staging of construction materials in conjunction with the Project. <br /> Section 5. INDEMNIFICATION. Jansen hereby agrees to defend, indemnify and <br /> hold the City harmless from any and all Claims for injury to people or damage to property <br /> arising out of or related to this License. This defense and indemnification obligation shall <br /> survive any termination, revocation or expiration of this Agreement. For the purpose of <br /> this Section 4, the following terms shall have their specified meaning. "City" means the <br /> page 1 <br />
