• • • ORDINANCE NO. Y 7 AN ORDINANCE approving and confirming the assessments and assessment roll of Local Improvement District No. 686, which was created for the improvement of portions of Xavier Way, Ballew Avenue, Pinkerton Avenue and an unnamed right-of-way along the east margin of the Plat of Beverly Viewlands Division 1 by the replacement of existing water distribution system with a new distribution system; and levying and assessing the amount thereof against the several lots, tracts, parcels of land and other property shown on said roll. WHEREAS, the assessment roll levying the special assessments against properties located in Local Improvement District No. 686 in the City of Everett, Washington, created under Ordinance No. 78-70 has been filed with the City Clerk of the City of Everett, Washington, as provided by law; and WHEREAS, notice of the time and place of hearing thereon and of making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 7th day of April, 1971, at the hour of 10:00 a. m. (PST), in the Council Chambers in the City Hall, Everett, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll; and WHEREAS, at the time and place fixed and designated in said notice, the hearing was duly held and all written protests received were duly considered and no persons appeared at said hearing, and the City Council being fully advised in the premises, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The assessments and assessment roll of Local Improvement District No. 686, which was created for the improvement of portions of Xavier Way, Ballew Avenue, Pinkerton Avenue and an unnamed right-of-way along the east margin of the Plat of Beverly Viewlands Division 1 by the replacement of existing water distribution system with a new distribution system; together with the necessary appurtenances, as provided in Ordinance No. 78-70, including the provision for issuance of bonds therefor, as the same now stand, be and the same are hereby in all things and respects approved and confirmed. Section 2: Each of the lots, tracts, parcels of land and other property shown upon the said roll is hereby determined and declared to be specially benefitted by said improvement in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon said roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon.
