<br /> AN ORDINANCE PROVIDING FOR THE VACATION OF:

<br /> The alley east of Rockefeller Avenue between
<br /> 4 3rd Street and 4th Street *hewn in Block 89,
<br /> Plat of Everett, Div. "St'; the Beast 12 feet
<br /> 5 " of 4th Street shown on the Plat of Everett,
<br /> Div. "8"; the alley east of Rockefeller between
<br /> 61 4th St. and 5th St., Block 104, Plat of Everett,
<br /> Div. "8" and 5th St. east of Rockefeller Ave.
<br /> 7 ' Plat of Everett, Div. "8".
<br /> 8 WHEREAS, the owners of more than two-thirds of the pri-
<br /> vate property abutting upon the streets and alleys above des-
<br /> 9 cribed have duly filed a petition with the City Council of the
<br /> City of Everett praying for vacation of said streets and alleys,
<br /> 10 and,
<br /> 11 WHEREAS, said City Council of the City of Everett did
<br /> by resolution duly adopted, fix the 1st day of April, 1968, at
<br /> 12 9:00 a.m, of said day for the hearing and determination of said
<br /> 13 petition, and,
<br /> WHEREAS, due and legal notice of the time and place of
<br /> 14 said hearing and the determination of said petition has been give i
<br /> by the City Clerk in the manner prescribed by law, and,
<br /> 15 `°
<br /> WHEREAS, at the time and place fixed for hearing, objec-
<br /> 16 tions to the vacating of the herein described streets were heard
<br /> and discussed, and,
<br /> 17d
<br /> WHEREAS, it now appears to the City Council of the City
<br /> 181
<br /> of Everett that a portion of said streets and alleys petitioned
<br /> 19 ,
<br /> to be vacated should be vacated,
<br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:

<br /> SECTION 1: That the streets and alleys of the City of
<br /> 21 ' Everett, Ubunty or Snohomish, State of Washington, described as
<br /> follows, to wit:

<br /> 23 The alley east of Rockefeller Avenue between
<br /> 3rd Street and. 4th, Street shown in Block 89,
<br /> Plat of Everett, Div. r'S"; the east 12 feet of
<br /> 261 4th Street shown on the Plat of Everett,
<br /> I Div. "8"; the alley east of Rockefeller between
<br /> 25 4th St. and 5th St. , Block 104, Flat of Everett,
<br /> Div'. "S" and 5th St. east• of Rockefeller Ave.
<br /> 26 Plat of Everett, Div. "S",
<br /> 27 , be, and the same is hereby vacated, SUBJECT TO the following
<br /> conditions, restrictions and reservations:

<br /> The City of Everett maintains an easement to
<br /> 29 ! construct, operate, maintain, repair, replace and
<br /> add thereto all sewer and water lines, and condi-
<br /> 30i tioned further that no structures of any permanent
<br /> nature shall ever be constructed over said streets
<br /> 31 and alleys so vacated.
