EVERETT CITY COUNCIL
RESOLUTION NO. 5601
A Resolution of the City Council
approving the Frauenholtz Request to amend the
Comprehensive Plan Map from a designation of
Single Family (1.2) to Multiple Family (1.6)
and rezone from R-2 (Single Family) to
R-3 (Multiple Family Medium Density), for a properties located
on the north side of Pecks Drive at Cady Road.
WHEREAS,the City of Everett adopted its Comprehensive Plan in August, 1994, in
conformance with the Washington State Growth Management Act; and
WHEREAS,the Growth Management Act, codified as Chapter 36.70A, allows for
comprehensive plans to be considered for amendment on an annual basis; and
WHEREAS, the City of Everett initiated its 2004 annual comprehensive plan amendment
process in July, 2004; and
WHEREAS,the proposed action(Exhibit "A") is to amend the Comprehensive Plan Map from
a Designation of Single Family(1.2)to Multiple Family(1.6) or Neighborhood Business (4.1)
and rezone from R-2 (Single Family) to R-3 (Multiple Family Medium Density) or B-1
(Neighborhood Shopping); and
WHEREAS,the Planning Commission held two public hearings on the matter on February 1,
2005 and continued it to March 1, 2005, at which time they had public testimony and heard from
the applicant, citizens and a staff presentation and considered the various aspects of the proposal;
and
WHEREAS, on March 1, 2005,the Everett Planning Commission recommended City Council
deny the application.

WHEREAS, THE EVERETT CITY COUNCIL FINDS:
1. The record of testimony before the Planning Commission shows the applicant's
representative requested the R-3 zone alternative be considered(with the attendant
Comprehensive Plan map amendment). The argument offered for the rezone to R-3 was that this
would relate the request for the Frauenholtz property to the legally non-conforming apartment
building east of and adjacent to the subject property; and
2. The stated purpose for the action is to allow use of the subject property to enjoy an
increased residential capacity and that this would require a rezone to R-3; and
3. The Everett Planning Commission had recommended against the proposed
Comprehensive Plan and rezone change and their desire is to keep this parcel and other parcels in
the area single family zoning; and
4. Nearby residents have testified they appreciate the single family character of the area and
would not want to see it begin to convert over to higher density residential use; and
5. The building height restriction of 28 feet for the development of multiple family
dwellings on the subject property will result in greater compatibility with the surrounding single
family neighborhood than the height that otherwise would be permitted in the R-3 zone; and
6. After testimony at the March 23, 2005, public hearing the Everett City Council has
decided to change the Comprehensive Plan and rezone the area subject to height conditions; and
7. The desire of the City Council is to improve the quality of the housing units in the area;
and
8. The location of these parcels on Pecks Drive makes logical sense to allow this rezone,
and it is not the intent for City Council by this action to set a precedent for other rezones to
multiple family in the area; and
9. Based on the statement of the applicant the desire to build 3 to 4 units on the parcel they
own which is being rezoned; and
NOW, THEREFORE, THE EVERETT CITY COUNCIL RESOLVES THAT:
1. The comprehensive plan land use designation for the properties designated on the
attached Exhibit A shall be changed from 1.2 "Single Family Detached, 5 to 10
Dwellings per Gross Acre"to "Multiple Family, 20 to 29 Dwellings per Gross Acre."
2. The subject properties shall be rezoned from R-2 (Single Family Detached Medium
Density) to R-3 (Multiple Family Medium Density), with a building height restriction of
28 feet.
