HomeMy WebLinkAboutOrdinance 664-80 • ORDINANCE NO. ‘ 61:4( (� An Ordinance amending the Zoning Map of the City of Everett, as provided by Everett Municipal Code, Title 19 (Ordinance 3572) WHEREAS, on December 18, 1979, the Planning Commission held a public hearing regarding rezoning the hereinafter described property from R-1 Single Family Low-Density Residential and C-1, General Commercial zones to R-1, Single-Family Low-Density Planned Residential Development, and WHEREAS, the City Council of Everett, after hearing the recommendations of the Planning Commission of the City of Everett, has determined that said property should be rezoned and zoned R-1, Single-Family Low-Density Planned residential Development (per Ordinance 414-76, Section 7D) NOW, THEREFORE, the City of Everett does ordain: Section 1: That the City Council of the City of Everett does hereby find that the PRD zoning change hereinafter set forth is in the best interest of the City of Everett and meets the purpose and requirements of the Planned Residential Development Ordinance No. 414-76. Section 2: That the proposed zoning is based on the applicant meeting the conditions stated in the attached development con- tract, and developing the rezoned area per the project site plan. Section 3: That the Zoning Map of the City of Everett as established by Everett Municipal Code Title 19 (Ordinance 3572, Section 4, as amended) is hereby amended as follows: Lots 1, 2, 3, 4, 5, 10, 11 and a portion of Lot 9 of the Plat of Intercity Addition No. 1, as per plat recorded in Volume 11 of Plats on page 9, records of Snohomish County, Washington, more particularly described as follows: Beginning at the Southwest corner of said Lot 9; thence North 310 East a distance of 236.52 feet to the Northwest corner of said Lot 9; thence North 89024' East a distance of 154.67 feet along the North line of said Lot 9; thence South 0036' East parallel with the East line of said Lot 9 a distance of 200 feet to the South line of said Lot 9; thence South 89024' West along the South line of said Lot 9 a distance of 280.94 feet to the Southwest corner of Lot 9 and the POINT OF BEGINNING. EXCEPT that portion of Lots 1, 2, 3, 4, 5, and 9 lying Southwesterly of a line which is parallel with and lies 90 feet Southwesterly as measured perpendicular to the Northeasterly line of said lots 1, 2, 3, 4, and 5. ALSO EXCEPT the East 160 feet of Lot 11 and the East 160 feet of the South 10 feet of Lot 10 of said Plat of Intercity Division No. 1. Section 4: This parcel, now zoned R-1 Single Family Low-Density Residential, is hereby rezoned and is now zoned R-1, Single-Family Low- Density Planned Residential Development. Section 5: Failure to meet the conditions of the attached contract shall result in reconsideration of this rezone action by the Planning Com- mission and City Council, and future development of said parcel shall then be subject to requirements of R-1, Single-Family Low-Density Residential Zoning per Ordinance 414-76, Section 7H. Section 6: The City Clerk is hereby instructed to file the fully certified copy of this Ordinance with the County Auditor of Snohomish County, Washington. DUJARDIN DEVELOPMENT COMPANY AND THE CITY OF EVERETT PLANNED RESIDENTIAL DEVELOPMENT #6-79 ' Final Development Plan Approval and subsequent issuance of construction ;permits for the Dujardin PRD on the parcel described in Rezone Ordinance No. 664-80 shall comply with the following conditions and requirements: • ! CONDITIONS 1. That the Final Development Plans for Phase I of the project • be developed according to the site plan given preliminary approval by City Council and will consist of the following elements: ';i a. 34 units in the form of 5 duplex and 6 fourplex units. b. 3.7 acres of open space including a tot lot, a play court, additional space for older children and a community center. • c. A private cul-de-sac internal road system with only one connection to a public street at 3rd Avenue. d. 60 parking spaces as indicated on the site plan with an open space area set aside for parking expansion (5 addi ' tional spaces to be developed if need arises as determined • by the Everett Traffic Engineer) . 2. , Landscaping Plan: That the landscaping plan show typical planting around units, narking areas, open space areas, and the perimeter • of the site (10 foot minimum to be retained as natural open space) . These detailed final plans shall be submitted and approved by the Planning Department prior to initiation of any building construction. 3. Off site improvements: That 3rd Avenue shall be improved from the north property line of the project to match the existing improve- ment on the west half of the street to the south (curb, gutter, and sidewalk on one side and approximately 20 feet of paving) . • An L.I.D. Power-of-Attorney for future cost participation in a • signal at 3rd Avenue and South Broadway is required. The project will only pay a portion of the signal cost based on proportionate need. Ii. 4. Internal Roads: In Phase I internal streets are to be 28 feet wide and perpendicular parking on both sides of the street. These internal Ij roads shall be constructed to City standards excluding width. . 5. Utilities: All water and sewer improvements designs shall be reviewed by Public Works per standards with a looped water system being required and layout which provides for reasonably long term durability and ease of maintenance. 'Maintenance of all Phase I facilities is the, responsi- bility of the Everett Housing Authority. 6. Drainage: City drainage ordinance shall, be complied with during • and after construction. Any improvement in the stream corridor will. require State Department of Game or Fisheries Hydraulic Project approval. • • • ti . jo li � 1 7. Recreation: Phase I plans include a tot lot to include a Timber- 1, farm #1325 Play .Cluster, a sport. court including •basketball hoop and an additional play area for older youngsters but not to include • 1, , ' the boat and cars indicated on the site plan. 8. Clearing Plan: A plan showing the extent of clearing and the methods • • of controlling erosion shall be presented to the Planning and Public j Works Departments prior to site work. . . 9. Sewer/Water Fees: Public Works Department shall make the determina- tion on the need for any fees in the area of utilities. The developer will he required to participate in the program to fund the South End Sewer Interceptor, paying $170.00 per unit or $5,780.00 for Phase I. ▪ 10. Bonding: A bond shall be posted to guarantee compliance with the • yfinal landscaping plan,. I; i il. Occupancy: No occupancy permitsshall be issued until the Planning • Department certifies that the Dujardin project has complied with the '; conditions of the PRD approval. I COMPLIANCE: • The Applicant agreed to develop the Planned, Residential Development on the • ,parcel described in Rezone Ordinance No. 664-80 according to the foregoing conditions. Any change in ownership of the property shall require written notice to the ' City of Everett Planning Department within 10 days, after which a meeting shall be held with the new owner and• his design team.
