An Ordinance amending the Zoning Map of the City of Everett, as provided by Everett Municipal Code, Title 19 (Ordinance 3572) WHEREAS, on July 9, 1979, the Planning Commission held a public hearing regarding rezoning of the hereinafter described property from R-S Residential Suburban to R-2 Single-Family High-Density Planned Residential Development, and WHEREAS, the City Council of Everett, after hearing the recommendations of the Planning Commission of the City of Everett, has determined that said property should be rezoned and zoned R-2 Single Family High Density Planned Residential Development (per Ordinance 414-76, Section 7D) NOW, THEREFORE, the City of Everett does ordain: Section 1: That the City Council of the City of Everett does hereby find that the PRD zoning change hereinafter set forth is in the best interest of the City of Everett and meets the purpose and requirements of the Planned Residential Development Ordinance No. 414-76. Section 2: That the proposed zoning is based on the applicant meeting the conditions stated in the attached development contract, and developing the rezoning area per the project site plan. Section 3: That the Zoning Map of the City of Everett as established by Everett Municipal Code Title 19 (Ordinance 3572, Section 4, as amended) is hereby amended as follows: West one-half of Government Lot 1, Section 19, Township 28 North, Range 5 East, W.M. , EXCEPT the North 500 feet thereof ALSO EXCEPT Roads. TOGETHER WITH a non-exclusive easement for road purposes over, along and across the North 60 feet of Tract 18, Broadway Farms #2, according to the plat thereof recorded in Volume 13 of plats, page 93, records of the Auditor of the County of Snohomish, State of Washington. This parcel, now zoned RS, Residential Suburban is hereby rezoned and is zoned R-2, Single Family High-Density Planned Residential Development. Section 5: That failure to meet the conditions of the attached contract shall result in reconsideration of this rezone action by the Planning Commission and City Council, and future development of said parcel shall then be subject to requirements of RS, Suburban Residential Zoning per Ordinance 414-76, Section 7H. Section 6: The City Clerk is hereby instructed to file the fully certified copy of this Ordinance with the County Auditor of Snohomish County, Washington. ATTEST: CITY OF EVERETT City Clerk, Mayor PASSED: / 6 -J / :..'- VALID: / j , .:7 Ocr" PUBLISHED: / ,3 J i DEVELOPMENT CONTRACT FOR JADE DEVELOPMENT PLANNED RESIDENTIAL DEVELOPMENT As Revised September 9, 1980 Final development Plan Approval and subsequent issuance of construction permits for the Jade Development PRD on the parcel described in Rezone Ordinance No. 639-79 shall not occur until the following have been satisfied: CONDITIONS 1. The final site plan shall consist of the following elements: I � (a) Up to 75 units in 75 structures with minimum lot size 3,000 square feet and minimum width 30 feet. Siting of units on lots and relationship to adjacent units. (b) A public street (cul-de-sac) off Third Avenue. (c) Private roads off the cul-de-sac to serve four subareas (d) 24 guest parking spaces (e) 4.2 acres of open space adjacent to the creek. (f) A 6-foot fence plus landscaping for perimeter screening. 2. That a detailed final landscaping plan be submitted to the Planning Department prior to any site work, showing the following: a. The trees to be retained in the open space area, and any supplemental planting needed to enhance the character of this portion of the site. b. The typical landscaping detail of each subarea and lot, including yard areas of each lot with particular attention given to the windowless wall areas as they relate to adjacent units. c. A typical section of the perimeter screening showing the fencing and landscaping in selected areas as determined by the Planning Department, and 25-foot setback on the entire perimeter. d. Specifics on how the creek area will be cleaned up and visually enhanced. e. Identity of the area and general nature of the active open space area. 3. That a phasing plan be submitted prior to final approval. 4. Off-Site Improvements: Third Avenue, adjacent to the project, shall be improved to City standards with 22 feet of paving; with curb, gutter, and sidewalk on the east side. Third Avenue, from the northwest corner of the project to Broadway, shall be improved to 22 feet of paving. 5. Internal Public Road: The access off Third Avenue into the project will be on • 30 feet of right of way; 24 feet of paving, curb and gutter; with sidewalk on one side constructed per attached specifications. (see Attachment A) 6. Private Roads: These shall be constructed to a width of 24 feet with a curb between the road and parking area, and constructed per attached specifications. (See Attachment A). 7. Utilities: All water and sewer improvement designs shall be reviewed by Public Works per standards and layout which provide for reasonably long term durability and ease of maintenance. The City and Jade Development and or assigns agree that the parties will enter into a latecomers agreement in accordance with Ordinance No. 7-11-80 to allow Jade Development and or assigns to recover costs from other property owners who connect to the water and sewer improvements constructed by Jade Development and or assigns and benefit from such improvements. 8. Building Design: Final building design shall be developed with attention given to • the design criterion in Attachment B and shall be per elevations and sketches presented to the Planning Commission at a public meeting. The Planning Director shall be notified by the applicant and shall review any building permit • applications for structures on this site. 9. Homeowners: A homeowner's association shall be established to handle maintenance of common areas and private streets; and there shall be guidelines, covenants, and deed restrictions for the maintenance of the structures on the { 1 individual lots. This would be presented prior to final plat approval. The homeowners' association will make provisions for an architectural review! committee to review remodeling additions, color or any other modification to the, structure. 10. Drainage: City drainage ordinance shall be complied with during and after con- struction. The area north of the road will be accepted by the Utilities Department for a regional drainage facility upon completion of a clean up and, open space enhancement program by the applicant. I.� ii 11. Recreation: The applicant shall develop an active recreation area for residents of the development. This would be developed in conjunction with the regional drainage facility, utilizing the blue-green concept. 12. Clearing and Grading Plan: A plan showing the extent of clearing and grading and the methods for controlling erosion shall be presented to the Planning it Department and Public Works Department prior to site work. I � 13. Occupancy: No occupancy permits shall be issued until the Planning Department certifies that the PRD project has complied with the conditions of the PRD! approval. 14. Schools: A fee for schools not to exceed $250 per unit shall be paid to the 9 I Mukilteo School District contingent upon a general policy regarding school fees being established by City Council prior to November 1, 1980. • 15. Public Works Fee: A fee for sewers shall be required in an amount to be determined by the Public Works Department based on total number and type of, units. 16. Bonding: A bond shall be posted to guarantee compliance with landscaping requirements. 17. Construction-Traffic: All construction vehicles shall use South Broadway for it access to the site. COMPLIANCE: The Applicant agrees to develop the Planned Residential Development on the parcel described in Rezone Ordinance No. 639-79 according to the foregoing conditions. 4 I AGREED TO THIS 1st DAY OF November, 1979. Wall on lot line must be a windowless wall. B. Particular attention must be given to the eventual relationship of one unit to , w another (accomplished by siting each unit). C. Sited properly, zero lot line homes can provide greater privacy than most conventional single family homes. D. Yards can be enclosed by walls to form garden courts or patios that afford maximum privacy. 11 'I E. Natural breaks, inserts, earth forms and landscaping can heighten variety. 11 F. Streetscape should alternate one and two story homes to maintain privacy of ; lower courtyards from upper windows. G. Massing of structures and roof slopes should be varied to create pleasing streetscapes. H. The small lot size of zero lot line concept requires close attention when screening occurs by way of fencing or landscaping. 1 I. Small lots require precise engineering and grading (for drainage and foundation work). J. Rolling topography is generally not suitable for zero lot line because expensive II retaining walls are often required to have lots drain properly. K. Integration of indoor and outdoor area important. That the project occur in the following phases; a. Phase I: Consisting of 4 four-plexes (16 units) , six guest parking spaces, private road, units set back 25 feet in southwest corner from south property line. The fourplex shall abut the interior public road. Third Avenue shall be improved as noted in Condition #4.. fl Phase II: 8 fourplexes (32 units) , 6 guest parking spaces, private road. c. Phase III: Extension of public road across creek, turnaround, 7 fourplexes (28 units) , 6 guest parking spaces, private road. d. Phase IV: 3 fourplexes (12 units) , 6 guest parking spaces, private road. • • • • 4.
