ORDINANCE NO.<'L,4.T.1 -7 7
AN ORDINANCE amending the Zoning Map of the City
of Everett as provided by Ordinance No. 3572 of
the City of Everett, also known as Everett City
Code 19. 04
WHEREAS , the Planning Commission has held a public
hearing regarding the rezoning of the hereinafter described
property from R-2, Single-Family High-Density to R-2 , Single-
Family High-Density/Planned Residential Development, and
WHEREAS, the City Council of the City of Everett, after
hearing the recommendation of the Planning Commission of the
City of Everett, has determined that said property should be so
rezoned and zoned R-2 (PRD) (Ordinance 414-76, Section 7D) .
NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
Section 1:
That the City Council of the City of Everett does hereby
find that the PRD zoning change hereinafter set forth
is in the best interest of the City of Everett and meets
the purpose and requirements of the Planned Residential
Development Ordinance No. 414-76 .
Section 2 :
That the proposed zoning change is based on the developer
meeting the conditions stated in the attached development
contract.
Section 3 :
That the Zoning Map of the City of Everett, as established
by Everett City Code 15. 04 . 040 (Ordinance No. 3572,
Section 4) is hereby amended as follows :
All of Lot 11 and the East 140 feet of Lots 12, 13 , and
the East 75 feet of Lot 10, Cady' s Addition to Beverly
Hills, and Lots 62 , 63 , and 64 Beverly Hills Division No. 3 .
This parcel, now zoned R-2 , Single-Family High-Density,
is hereby rezoned and is zoned R-2 , Single-Family High-
Density/Planned Residential Development.
Section 4 :
That the official zoning map shall upon the passage of this
Ordinance be amended by the City Clerk, as hereinabove
provided, and henceforth said property shall be used in
accordance with the development requirements stated in
the attached contract.

Section 5 :
That failure to meet the conditions of the attached
contract shall result in reconsideration of this rezone
action by the Planning Commission and City Council, and
future development of said parcel shall then be subject
to requirements of the R-2 , Single-Family High-Density
Zoning per Ordinance 414-76, Section 7H
Section 6 :
The City Clerk is hereby instructed to file the duly
certified copy of this Ordinance with the County
Auditor of Snohomish County, Washington.

PRELIMINARY APPROVAL CONDITIONS
FOR
TED SCHMELZER PLANNED
RESIDENTIAL DEVELOPMENT (PRD)
Final Development Plan approval and subsequent issuance of con-
struction permits for the Ted Schmelzer PRD on the parcel described
in the Rezone Ordinance No. 452 -77 shall not occur until the
following conditions have been satisfied:
1. That the project consist of 12 lots.
2 . That the setback lines be marked on the final plan as
follows :
a. Front yard; 10 feet, except in front of garage or car-
port where it shall be 20 feet.
b. Side yard; zero setback on lots 2 , 3 , 4 , 5, 6 , portion
of 8 , 9 , 10; and west lot line of lots 1 and 11. East
lot line of lots 1 and 11 shall have a 20 foot setback.
c. Rear yard, 20 feet.
3 . The street configuration shall be as follows :
a. Dedicated public right-of-way, 34 feet.
b. Paved roadway of 23 feet, with rolled curbs, for a
width of 26 feet, and with a turnaround right-of-way
radius of 40 feet, and a paved radius of 36 feet.
c. Sidewalks on both sides, concrete, 4 feet wide.
d. Two 10-foot utility easements on each side of the
road for utilities .
4 . That a grading plan be presented prior to issuance of
construction permits showing the extent of clearing and
trees to be removed.
5. That lot coverage by buildings shall not exceed 33% .
6. That a final conceptual landscaping plan and inventory
of existing vegetation be developed prior to issuance of
any construction permits .
7. That prior to issuance of construction permits for any
activity or structures on the specific lots , the Planning
Director shall review the site plan for compliance with
setbacks, lot coverage, and preservation of vegetation.
8. Final approval of the PRD by Planning Commission and City
Council shall also constitute preliminary plat approval,
which permits construction after approval of public improve-
ment plans.
9 . Final acceptance of the public improvements shall be per
City Subdivision Code Title 18 .
10. That the final development plan be developed by the
architect involved in the preliminary plan.
11. That a restrictive covenant be attached to the lots which
would allow only two vehicles per family to be regularly
parked on the site and no recreational vehicles , or boats
to be parked on the site.
Compliance
1. The applicant agrees to compliance with the above stipu-
lations prior to issuance of any and all construction
permits.
