2 AN ORDINANCE amending the Zoning Map of the City
of Everett as provided by Ordinance No. 3572 of the
3 City of Everett, also known as Everett City Code 19. 04 .
4 WHEREAS, the Planning Commission has held -a public
5 hearing regarding the rezoning of the hereinafter described
6 property from R-2, Single-Family High-Density to R-2 , Single-
7 Family High-Density/Planned Residential Development, and
8
9 WHEREAS, the City Council of the City of Everett,
10 after hearing the recommendation of the Planning Commission
11 of the City of Everett, has determined that said property
12 should be so rezoned and zoned R-2 (PRD) (Ordinance 414-76,
13 Section 7 D) .

15 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:

17 Section 1 :
18 That the City Council of the City of Everett does
19 hereby' find that the PRD zoning change hereinafter
20 set forth is in the best interest of the City of
21 Everett and meets the purpose and requirements
22 of the Planned Residential Development Ordinance
23 (414-76) .

25 Section 2 :
26 That the proposed zoning change is based on the
27 developer meeting the conditions stated in the attached
28 development contract.

30 Section 3 :
31 That the Zoning Map of the City of Everett, as
32 established by Everett City Code 15. 04. 040 (Ordinance

1 No. 3572, Section 4) is hereby amended as follows:

3 All that portion of the Southwest quarter of the
Southeast quarter of the Southeast quarter of Sec-
4 tion 1, Township 28 North, Range 4 , East W.N. ,
described as follows:

Beginning at the Northwest corner of said Subdivision;
6 thence South 1 13 ' 40" East along the West line o-
said Subdivision, 250 feet to the true point of
7 beginning; thence North 88 03 ' 52" East, 267. 21 feet;
thence South 1 13 ' 15" East to the North margin of
8 Beverly Park/Maple Heights County Road; thence North-
westerly, along the Northerly margin of said road
9 to the West line of said Southwest quarter of South-
east quarter of Southeast quarter; thence North
10 1 13 ' 40" West along said West line to the true point
of beginning. Situated in Snohomish County, Washing-
11 ton.

13 This parcel, now zoned R-2 , Single-Family High-Density,
14 is hereby rezoned and is zoned R-2, Single-Family
15 High-Density/Planned Residential Development.

17 Section 4 :
18 That the official zoning map shall upon the passage
19 of this Ordinance be amended by the City Clerk,
20 as hereinabove provided, and henceforth said property
21 shall be used in accordance with the development
22 requirements stated in the attached contract.

24 Section 5 : That failure to meet the conditions
25 of the attached contract shall result in Planning
26 Commission' s and City Council ' s reconsideration
27 of this rezone action, and future development
28 of said parcel shall then be subject to requirements
29 of the R-2, Single-Family High-Density Zoning per
30 Ordinance 414-76 , Section 7 H.

1 Section 6 :
2 The City Clerk is hereby instructed to file the
3 duly certified copy of this Ordinance with the County
4 Auditor of Snohomish County, Washington.
