MINN <br /> RESOLUTION NO. 7382 E V E R E T T <br /> WASHINGTON <br /> A Resolution amending the Development Agreement for the Port of <br /> Everett Waterfront Place Central Planned Development Overlay Zone, , <br /> amending Resolution No. 5382 as amended <br /> WHEREAS, the City Council finds the following: <br /> 1. In 2003, the City Council adopted Resolution No. 5382, approving a Planned <br /> Development Overlay (PDO) Zone rezone and master plan for property owned by the <br /> Port of Everett (Port), creating a mixed-use master plan providing for commercial, <br /> residential and recreational uses, with a Development Agreement(DA) as permitted by <br /> RCW 36.70B.170. <br /> 2. In 2005, the City Council adopted Resolution No. 5703, amending the PDO master plan <br /> approved under Resolution No. 5382. <br /> 3. In 2015, the City Council adopted Resolution 6814, amending the PDO master plan and <br /> an adopting an amended are restated DA between the City and the Port of Everett. <br /> 4. The Port has been implementing elements of the master plan, including recreational boat <br /> service businesses, commercial development, and public access improvements. <br /> 5. The Port has proposed a revision to the alignment of Weaver Street, to straighten the <br /> street by removing an angled turn in the currently approved alignment which requires <br /> revisions to Exhibits 1 and 3 of Exhibit A of Resolution No. 5382 as amended. <br /> 6. The City's PDO Zone regulations classify the proposed change to the master plan as a <br /> major amendment. <br /> 7. Major amendments to a PDO master plan require review by the Planning Commission <br /> and City Council. <br /> 8. Major amendments to a PDO master plan must provide for the best long-term interests of <br /> the community, be consistent with the Everett Comprehensive Plan, and mitigate impacts <br /> to surrounding properties. <br /> 9. The Port has provided detailed materials explaining the reasons for, and benefits of, the <br /> realignment of Weaver Street, which include improving the usability of the properties <br /> located on both sides of Weaver Street. <br />
