RESOLUTION NO. 7382 E V E R E T T
WASHINGTON
A Resolution amending the Development Agreement for the Port of
Everett Waterfront Place Central Planned Development Overlay Zone, ,
amending Resolution No. 5382 as amended
WHEREAS, the City Council finds the following:
1. In 2003, the City Council adopted Resolution No. 5382, approving a Planned
Development Overlay (PDO) Zone rezone and master plan for property owned by the
Port of Everett (Port), creating a mixed-use master plan providing for commercial,
residential and recreational uses, with a Development Agreement(DA) as permitted by
RCW 36.70B.170.
2. In 2005, the City Council adopted Resolution No. 5703, amending the PDO master plan
approved under Resolution No. 5382.
3. In 2015, the City Council adopted Resolution 6814, amending the PDO master plan and
an adopting an amended are restated DA between the City and the Port of Everett.
4. The Port has been implementing elements of the master plan, including recreational boat
service businesses, commercial development, and public access improvements.
5. The Port has proposed a revision to the alignment of Weaver Street, to straighten the
street by removing an angled turn in the currently approved alignment which requires
revisions to Exhibits 1 and 3 of Exhibit A of Resolution No. 5382 as amended.
6. The City's PDO Zone regulations classify the proposed change to the master plan as a
major amendment.
7. Major amendments to a PDO master plan require review by the Planning Commission
and City Council.
8. Major amendments to a PDO master plan must provide for the best long-term interests of
the community, be consistent with the Everett Comprehensive Plan, and mitigate impacts
to surrounding properties.
9. The Port has provided detailed materials explaining the reasons for, and benefits of, the
realignment of Weaver Street, which include improving the usability of the properties
located on both sides of Weaver Street.
10. The Planning Commission held a public hearing on April 16, 2019, and adopted a
resolution recommending that the City Council approve the proposed amendment to the
PDO master plan.
WHEREAS, the City Council concludes the following:
1. The proposed major amendment to the Waterfront Place PDO master plan:
a. is consistent with the Everett Comprehensive Plan;
b. does not create any impacts to surrounding properties that require mitigation; and
c. is in the best long-term interests of the Everett community.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVERETT:
Section 1. Section 2 of Resolution No. 5382 as amended by Resolution Nos. 5703 and 6814 is
amended to substitute Exhibits 1 and 3 in Exhibit A of the Amended and Restated Development
Agreement with the revised attached Exhibits 1 and 3 to Exhibit A.
Section 2. This Resolution authorizes the Mayor to sign the this First Amendment to the
Amended and Restated Development Agreement between the City of Everett and Port of
Everett for the Waterfront Place Planned Development Place Planned Development
Overlay Zone Master Plan. This Resolution along with the First Amendment including
exhibits shall be recorded with the Snohomish County Auditor's Office and shall be a
covenant running with the land.
Section 3. The City Clerk and the codifiers of this Resolution are authorized to make necessary
corrections to the Resolution and exhibits, including but not limited to, correction of scrivener's/
clerical errors, references, resolution numbering, section and subsection numbers, and any
references thereto.

FIRST AMENDMENT TO THE AMENDED AND RESTATED DEVELOPMENT
AGREEMENT BETWEEN THE CITY OF EVERETT AND PORT OF EVERETT FOR THE
WATERFRONT PLACE PLANNED DEVELOPMENT OVERLAY ZONE MASTER PLAN
This First Amendment to the Amended and Restated Development Agreement between the City
of Everett and Port of Everett for the Waterfront Place Planned Development Overlay Zone
Master Plan is entered into thisZ day of h11,2019, by and between the Port of Everett, a
Washington Port District(hereinafter, "the ort")and the City of Everett,a municipal corporation
under the laws of the State of Washington (hereinafter, "the City").
WHEREAS, the City and Port executed an Amended and Restated Development Agreement on January
21, 2015, concerning a redevelopment plan on property owned by the Port, known as Waterfront Place,
for a mixed use master land use plan; and
WHEREAS,the Port applied to the City for an amendment to the master plan involving the realignment
of Weaver Street within the master plan; and
WHEREAS,the City Council has approved the amendment changing the alignment of Weaver Street as
depicted on Exhibit 1, attached to this Amendment; and
WHEREAS,the amendment depicted on the attached Exhibits necessitates the amendment of Exhibit 1
(Conceptual Site Plan) of Exhibit A and Exhibit 3 (Right-of-Way Improvements) of Exhibit A of the
Amended and Restated Development Agreement, and
NOW THEREFORE,the parties herein do hereby mutually agree as follows:
1. Exhibit 1 and Exhibit 3 of Exhibit A of the Amended and Restated Development Agreement shall
be replaced with new exhibits that change only the alignment of Weaver Street as depicted in
the attached exhibits of this First Amendment.
2. The revised Exhibits 1 and 3 of Exhibit A shall govern design and construction of improvements
and the application of development standards for future development within the Waterfront
Place Planned Development Overlay zone master plan.
3. All other terms and conditions of the Amended and Restated Development Agreement Between
The City of Everett And Port of Everett For The Waterfront Place Planned Development Overlay
Zone Master Plan shall remain in full force and effect.
