Section 9.28.070 License . No person shall drive <br /> 1 a motorcycle unless such person 'has a valid driver 's license <br /> specifically endorsed by the Director of the State Department of <br /> 2 Licenses to enable the holder to drive such vehicle . <br /> 3 Section 9.28.080 Engine and Exhaust System. <br /> 4 (1) Every motor vehicle shall at all times be <br /> equipped with a muffler in good working order <br /> 5 and in constant operation to prevent excessive <br /> or unusual noise, and no persons shall use a <br /> 6 muffler cut-out, by-pass, or similar device <br /> upon a motor vehicle upon a highway. <br /> 7 <br /> (2) The engine and power mechanism of every motor <br /> 8 vehicle shall be so equipped and adjusted as <br /> to prevent the escape of excessive fumes or <br /> 9 smoke . <br /> 10 (3) No person shall modify the exhaust system of a <br /> motorcycle in a manner which will amplify or <br /> 11 increase the noise emitted by the engine of <br /> such vehicle above that emitted by the muffler <br /> 12 originally installed on the vehicle, and it <br /> shall be unlawful for any person to operate <br /> 13 a motorcycle not equipped as required by this <br /> subsection, or which has been amplified as pro- <br /> 14 hibited by this subsection. <br /> 15 Section 9.28.090 Equipment . It shall be unlawful: <br /> 16 (1) for any person to operate a motorcycle not <br /> equipped with a mirror on each side of the <br /> 17 handlebars thereof; the two mirrors shall be so <br /> located as to give the driver a complete view <br /> 18 of the highway for a distance of at least 200 <br /> feet to the rear of the motorcycle . <br /> 19 <br /> (2) for any person to operate a motorcycle in <br /> 20 excess of 35 miles per hour which does not <br /> have a windshield unless he wears goggles or <br /> 21 a face shield of a type approved by the <br /> Washington State Commission on Equipment . <br /> 22 <br /> (3) for any person to operate or ride upon a motor- <br /> 23 cycle unless he wears a protective helmet of a <br /> type approved by the Washington State Commission <br /> 24 on Equipment . Such a helmet must be equipped <br /> with either a neck or a chin strap which shall <br /> 25 be fastened securely while the motorcycle is in <br /> motion. <br /> 26 <br /> (4) for any person operating a motorcycle to ride <br /> 27 on other than the permanent and regular seat <br /> attached thereto, and such operator shall not <br /> 28 carry any other person, nor shall any other <br /> person ride on a motorcycle unless such motor- <br /> 29 cycle is designed to carry more than one person, <br /> in which event a passenger may ride upon a per <br /> 30 manent and regular seat if designed for two <br /> persons, or upon another seat firmly attached <br /> 31 to the rear or side of the operator, provided, <br /> however, that the motorcycle must contain foot <br /> 32 pegs of a type approved by the State Commission <br /> on Equipment. <br /> - 2 - <br />
