2 <br /> Exhibit 12 Snohomish County Assessors Record dated July 21, 2014 with <br /> structure information <br /> Exhibit 13 Go Sync Maps <br /> Exhibit 14 Exhibit List dated July 24, 2014 <br /> Based upon a review of the above record, the following Findings of Fact and <br /> Conclusions of Law hereby constitute the basis of the decision of the Everett Violations <br /> Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Patrick H. Garrity, Respondent, is the owner of record of the property at 3405 Bell <br /> Avenue, Everett, Washington (property). The property is in an R-1 Single Family <br /> Detached Low Density zone as established by the City of Everett. (Exhibit#12, <br /> Snohomish County Assessors Record dated July 21, 2014 with structure <br /> information) (Exhibit#13, Go Sync Maps) <br /> 2. On March 21, 2014, Everett Code Enforcement(ECE) Officer Cindy Keirsey <br /> inspected the property and observed and photographed what appeared to be a <br /> daylight basement in a residential structure. According to City records there was no <br /> evidence of a duplex legally being constructed or permitted on the property. (Exhibit <br /> #2n-2o, Inspection Photos dated March 21, 2014) (Testimony of Code Enforcement <br /> Officer Keirsey) <br /> 3. On March 24, 2104, the Respondent allowed ECE Officer Keirsey to conduct an <br /> inspection of the property, who, while on site, observed and photographed that a <br /> studio apartment had been constructed in the daylight basement. She noted that <br /> the unit consisted of an open area with a kitchen and a bathroom. There was no <br /> interior access between the lower and upper units. The Respondent informed ECE <br /> Officer Keirsey that he occupied the basement apartment and rented the upper <br /> portion of the single family structure. The Respondent informed ECE Officer <br /> Keirsey that he would be pursuing permits for an accessory dwelling unit. (Exhibit <br /> #2m, Inspection Photo dated March 24, 2014) (Testimony of Code Enforcement <br /> Officer Keirsey) <br /> 4. On March 25, 2014, Steve ingalsbe, Everett Planning Department, informed ECE <br /> Officer Keirsey that in order to qualify for an accessory dwelling unit, City code <br /> requires the property lot to be 5,000 square feet. The square footage of the subject <br /> property is 4,500. Mr.ingalsbe further stated that the kitchen in the daylight <br /> basement would have to be removed and an internal connection between the lower <br /> and upper floors be reestablished. The Respondent would be allowed two roomers <br /> in an R-2 single family residential zone. (Exhibit#6, Email from Steve ingalsbe <br /> dated March 25, 2014) (Testimony of Code Enforcement Officer Keirsey) <br /> 5. On March 26, 2014, a notice to comply was sent to the Respondent via first class <br /> mail. The notice provided a corrective action date of May 19, 2014 to apply for the <br />
