(c) The complaint shall be returnable before the <br /> Housing and Building Administrator issuing said complaint . This <br /> officer may determine that the dwelling, building or structure <br /> is unfit for human habitation or other use, if he finds that <br /> conditions exist in such building or structure as defined in <br /> Section 2.24.010 of this chapter after applications of the stand- <br /> ards as defined in Section 2 .24.011 of this chapter. <br /> (d) After a hearing as provided for herein before the <br /> Housing and Building Administrator issuing the complaint, said <br /> officer shall enter findings in writing. If the determination <br /> is that the dwelling is unfit for human habitation or the build- <br /> ing or structure is unfit for otheruse, or must be demolished, <br /> repaired, or improved; then such determination shall be set forth <br /> in findings of fact by the Housing and Building Administrator. <br /> Said Housing and Building Administrator shall issue and cause to <br /> be served upon the owners or other parties in interest as pro- <br /> vided herein and shall post in a conspicuous place on said prop- <br /> erty an order which requires the owners or other parties in <br /> interest to repair, alter or improve such building, dwelling or <br /> structure, to render it fit for human habitation or other use, <br /> or to vacate and close said dwelling, building, or structure, <br /> within the time specified in said order, if such course of action <br /> is deemed proper on the basis of the standards set forth in this <br /> chapter. The Housing and Building Administrator shall remove <br /> or demolish such structure, dwelling or building if this course <br /> of action is deemed proper on the basis of said standards . If <br /> no appeal is filed within the time set forth in this chapter, <br /> a copy of such order shall be filed with the Auditor of Snohomish <br /> County. <br /> (e) It shall be the responsibility of the Housing <br /> and Building Administrator to diligently prosecute the terms of <br /> such order after the same has been entered, and to enforce the <br /> penalty provisions of this chapter. <br /> (f) It shall be the duty of the Housing and Building <br /> Administrator and all other inspectors or officers as defined in <br /> this chapter, making reports to the Housing and Building Adminis- <br /> trator of dangerous buildings, to appear at all hearings before <br /> the Housing and Building Administrator, the Board of Appeals <br /> hearings, in the Municipal Court, and to further appear in any <br /> Superior Court at the instance and direction of the City Attorney, <br /> to testify as to the condition of "dangerous buildings . ' <br /> Section 3 : That ECC 2.24.030 be, and the same is <br /> hereby amended, to read as follows, to wit: <br /> 2.24.030 Notice of Complaint - Service. The complaint <br /> of the Housing and Building Administrator shall be served either <br /> personally or by registered mail upon all persons having any in- <br /> terest in the subject property upon which the alleged building <br /> is situated as shown upon the records of the Snohomish County <br /> Auditor. A copy of said complaint, together with a hearing <br /> notice, shall be posted in a conspicuous place on such property. <br /> If the whereabouts of such person or persons in interest in the <br /> property is unknown and the same cannot be ascertained by the <br /> Housing and Building Administrator in the exercise of reasonable <br /> diligence, the Housing and Building Administrator shall make <br /> an affidavit to that effect . The serving of such complaint and <br /> notice or order upon such person or persons may then be made by <br /> publishing the same once each week for two consecutive weeks in <br /> a newspaper published in tifie City of Everett, and in the event <br /> of inability to publish, such hearing notice and complaint shall <br /> be posted in three public places in the municipality of the City <br /> of Everett . Such complaint and notice shall state that a hearing <br /> - 3 - <br />
