Anyone removing said complaint and/or order iss ed upon said complaint shall be guilty of a misdemeanor and subjest to fine and imprisonment as herein- after set forth. Section 5: That ECC 2.24.050 be, and the same is hereby amended, to read as follows, to wit: 2 .24.050 Unlawful occupancy. It shall be unlawful for any occupant to remain in or reside in any building which has been properly posted with an order as provided in Section 2.24.060 of this chapter until such time as said order has been removed by the order of the Housing and Building Administrator of said city. Section 6: That ECC 2.24.060 be, and the same is hereby amended, to read as follows, to wit: 2.24.060 Board of Appeals; Housing and Building Adminis- trator's duties; appeal fo Superior Court; eftect of noncompliance with Housing and Building Administra-torrs order. (a) In order to provide for a reasonable interpreta- tion of this "dangerous building" ordinance, there is hereby created a Board of Appeals consisting of five members who are qualified by experience and training on matters pertaining to building construction. Each member of the Board to be appointed by the Mayor and approved by the Council, to serve without compen- sation for a term of three years, subject to removal by the Mayor, and approved by the Council . No member of the Board shall be an officer or employee of the City of Everett . Original appointees to said Board shall serve staggered terms of: one for one year, two for two years and two for three years, respectively. No member of said Board shall serve more than two successive terms . Said Board shall consist of the same members that compose the Board of Appeals as provided for in Section 204 of the Uniform Building Code (ECC 2.12.010) . The Board of Appeals shall review any complaints involving alleged violations of this Ordinance, brought before it by the Housing and Building Administrator, and make recommendations to said Housing and Building Administrator with respect thereto. (b) The Board of Appeals may adopt rules and regulations for its own government, noti inconsistent with the provisions of this or any other Ordinance of the City of Everett . Meetings of the Board shall be held at the call of the Chairman of said Board, and at such other times as the Board may determine . - 4 -
