Anyone removing said <br /> complaint and/or order iss ed upon said complaint shall be guilty <br /> of a misdemeanor and subjest to fine and imprisonment as herein- <br /> after set forth. <br /> Section 5: That ECC 2.24.050 be, and the same is <br /> hereby amended, to read as follows, to wit: <br /> 2 .24.050 Unlawful occupancy. It shall be unlawful <br /> for any occupant to remain in or reside in any building which has <br /> been properly posted with an order as provided in Section 2.24.060 <br /> of this chapter until such time as said order has been removed by <br /> the order of the Housing and Building Administrator of said city. <br /> Section 6: That ECC 2.24.060 be, and the same is <br /> hereby amended, to read as follows, to wit: <br /> 2.24.060 Board of Appeals; Housing and Building Adminis- <br /> trator's duties; appeal fo Superior Court; eftect of noncompliance <br /> with Housing and Building Administra-torrs order. <br /> (a) In order to provide for a reasonable interpreta- <br /> tion of this "dangerous building" ordinance, there is hereby <br /> created a Board of Appeals consisting of five members who are <br /> qualified by experience and training on matters pertaining to <br /> building construction. Each member of the Board to be appointed <br /> by the Mayor and approved by the Council, to serve without compen- <br /> sation for a term of three years, subject to removal by the Mayor, <br /> and approved by the Council . No member of the Board shall be an <br /> officer or employee of the City of Everett . Original appointees <br /> to said Board shall serve staggered terms of: one for one year, <br /> two for two years and two for three years, respectively. No <br /> member of said Board shall serve more than two successive terms . <br /> Said Board shall consist of the same members that compose the <br /> Board of Appeals as provided for in Section 204 of the Uniform <br /> Building Code (ECC 2.12.010) . The Board of Appeals shall review <br /> any complaints involving alleged violations of this Ordinance, <br /> brought before it by the Housing and Building Administrator, and <br /> make recommendations to said Housing and Building Administrator <br /> with respect thereto. <br /> (b) The Board of Appeals may adopt rules and regulations <br /> for its own government, noti inconsistent with the provisions of <br /> this or any other Ordinance of the City of Everett . Meetings of <br /> the Board shall be held at the call of the Chairman of said Board, <br /> and at such other times as the Board may determine . <br /> - 4 - <br />
