Violations & EMC Sections <br /> Inspection of the property reveals the following conditions and violations: <br /> An inspection of the property on April 3, 2017 revealed the residential structure is <br /> occupied without approved water service. The City of Everett Utilities Department <br /> reported the water has been shutoff for non-payment since January 23, 2017 and <br /> on April 13, 2017, the Public Utilities District reported the electrical service is also <br /> disconnected. During the April 3rd contact, the tenant Kevin L. Kyle, stated 2 adults <br /> and 1 child live in the basement. The Snohomish County Assessor records describe <br /> the house as a 1 1/2 story single family residence with an unfinished basement. A <br /> search of Permit History reveals no evidence the basement has ever been converted <br /> to living space. Further evidence of unpermitted alteration of the basement and <br /> occupancy include a Police Report #2016-75820 in which Kevin Kyle told officers the <br /> suspect there were seeking was in the downstairs apartment. <br /> The unpermitted alteration of the residential structure, by building and attaching the <br /> new addition, is a violation of International Residential Code (IRC) R105.1 <br /> which reads: <br /> IRC R105,1 Required, <br /> Any owner or authorized agent who intends to construct, enlarge, alter, <br /> repair, move, demolish or change the occupancy of a building or structure, <br /> or to erect, install, enlarge, alter, repair, remove, convert or rep/ace any <br /> electrical, gas, mechanical or plumbing system, the installation of which is <br /> regulated by this code, or to cause any such work to be done, shall first <br /> make application to the building official and obtain the required permit. <br /> _ 4 <br /> The unpermitted alteration further renders the residential structure Unlawful as <br /> defined by International Property Maintenance Code (IPMC) 108.1.4, in <br /> violation of IPMC 106.1, which reads: <br /> IPMC 108.1,4 Unlawful Structure, An unlawful structure is one found in <br /> whole or in part to be occupied by more persons than permitted under this <br /> code, or was erected, altered or occupied contrary to law. <br /> Everett Police Department,Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 <br /> "'age2of5 <br />
