IPMC 106.1 Unlawful acts. <br /> It shall be unlawful for a person, firm or corporation to be in conflict with or in <br /> violation of any of the provisions of this code. <br /> With respect to these violations the respondent, Brian Oltman, is a "repeat <br /> violator"because the hearing examiner found the respondent liable for <br /> violations of the same EMC chapter within the last 24 months. <br /> The absence of approved water and electrical services are violations of <br /> International Property Maintenance (IPMC) Code 505.1 and 604.1 as <br /> adopted by the Everett Municipal Code (EMC) which read; <br /> IPMC 505.1 General. <br /> Every sink, lavatory, bathtub or shower, drinking fountain, water closet or other <br /> plumbing fixture shall be properly connected to either a public system or to an <br /> approved private water system. All kitchen sinks, lavatories, laundry facilities, <br /> bathtubs and showers shall be supplied with hot or tempered and cold running <br /> water in accordance with the International Plumbing Code, <br /> IPMC 604.1 Facilities required, <br /> Every occupied building shall be provided with an electrical system in <br /> compliance with the requirements of this section and Section 605. <br /> With respect to these violations the respondent, Brian Oltman, is a "repeat <br /> violator"because the hearing examiner found the respondent liable for <br /> violations of the same EMC chapter within the last 24 months. <br /> The absence of systems to provide heat, light, and sanitation to the structure(s) <br /> renders them unfit for human habitation as defined by IPMC 108.1.3 in violation of <br /> IPMC 106.1 which reads; <br /> IPMC 108,1,3 Structure Unfit for Human Occupancy <br /> A structure is unfit for human occupancy whenever the Code Official finds that <br /> such structure in unsafe, unlawful or, because of the degree to which the <br /> structure is in disrepair or lacks maintenance, is unsanitary, vermin or rat <br /> infested, contains filth or contamination, or lacks ventilation, illumination, <br /> sanitary or heating facilities or other essential equipment required by this code, <br /> or because of the location of the structure constitutes a hazard to occupants of <br /> the structure or to the public. <br /> With respect to these violations the respondent, Brian Oltman, is a "repeat <br /> violator"because the hearing examiner found the respondent liable for <br /> violations of the same EMC chapter within the last 24 months. <br /> Everett Police Department,Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 <br /> =.g: <br /> of5 <br />
