r . r • •• • • • ORDINANCE NO. /r., AN ORDINANCE RELATING TO PUBLIC HEALTH AND SANITATION: REGULATING THE OPERATION OF THE WASTE DISPOSAL SITE OWNED OR OCCUPIED BY THE CITY OF EVERETT AT 36TH AND MAPLE STREETS IN SAID CITY OF EVERETT, PROVIDING FOR THE DISPOSAL OF GAR- BAGE, REFUSE, AND WASTE AT SAID DISPOSAL SITE, ESTABLISHING AND CREATING A SANITARY LANDFILL AT SAID DISPOSAL SITE: ESTABLISHINGHOURS AND DAYS DURING WHICH TIME WASTE MATERIAL MAY BE DEPOSITED AT SAID DISPOSAL SITE: ESTABLISHING FEES TO BE CHARGED FOR THE PRIVILEGE OF DEPOSITING WASTE MATER- IAL ATERIAL AT SAID DISPOSAL SITE: PROVIDING FOR PENALTIES FOR VIO- LATION THEREOF; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY TO EXIST. NOW, THEREFORE, be it ordained by the City of Everett as follows: Section 1: That the maintenance of health and sanita- tion in the City of Everett require that the City exercise control over that area of land owned and occupied by the City commonly referred to as the City disposal site at 36th and Maple Streets in said city, and more particularly des- cribed as follows: All of Blocks 13, 14, 17 , 18, 27 , 28 , 31, and 42, less a portion of Block 1 described as follows: All in Sines Acre Tracts, beginning at the SE corner of Block 31; thence W 79 feet; thence northeasterly on a radius of 1,860 feet for 407 .5 feet to NE corner of said block; thence S to point of beginning; and all land leased by the City of Everett from the Northern Pacific Railway Company contiguous with the above-described real property. Further, it is necessary to provide for the propert maintenance of health and sanitation control in the City of Everett. That said disposal site be operated as a sanitary landfill; and it is further necessary for the City of Everett to provide for the handling of the delivery of waste material to said disposal site. Section 2: Definitions. The following definitions of terms as used in this ordinance shall apply in the en- forcement and application thereto, to-wit: (a) "Waste" shall be taken to mean all put- recible and non-putrecible waste from all public or private dwellings and establishments and except carcasses of dead animals, including, but not limited to, all garbage, waste, rubbish, debris, discarded food, swill, animal and vegetable matter, waste papers, cans, glass, ashes, offal, boxes , brush, shrubs, and garden leaves, unattached por- tions of trees, bushes or shrubs, and refuse, except sewage from all public or private dwellings and establishments and except carcasses of dead animals. -1- ORDINANCE
