r . r • •• <br /> • <br /> • <br /> • <br /> ORDINANCE NO. /r., <br /> AN ORDINANCE RELATING TO PUBLIC HEALTH AND SANITATION: <br /> REGULATING THE OPERATION OF THE WASTE DISPOSAL SITE OWNED <br /> OR OCCUPIED BY THE CITY OF EVERETT AT 36TH AND MAPLE STREETS <br /> IN SAID CITY OF EVERETT, PROVIDING FOR THE DISPOSAL OF GAR- <br /> BAGE, REFUSE, AND WASTE AT SAID DISPOSAL SITE, ESTABLISHING <br /> AND CREATING A SANITARY LANDFILL AT SAID DISPOSAL SITE: <br /> ESTABLISHINGHOURS AND DAYS DURING WHICH TIME WASTE MATERIAL <br /> MAY BE DEPOSITED AT SAID DISPOSAL SITE: ESTABLISHING FEES <br /> TO BE CHARGED FOR THE PRIVILEGE OF DEPOSITING WASTE MATER- <br /> IAL <br /> ATERIAL AT SAID DISPOSAL SITE: PROVIDING FOR PENALTIES FOR VIO- <br /> LATION THEREOF; AND REPEALING ALL ORDINANCES OR PARTS OF <br /> ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY <br /> TO EXIST. <br /> NOW, THEREFORE, be it ordained by the City of Everett <br /> as follows: <br /> Section 1: That the maintenance of health and sanita- <br /> tion in the City of Everett require that the City exercise <br /> control over that area of land owned and occupied by the <br /> City commonly referred to as the City disposal site at 36th <br /> and Maple Streets in said city, and more particularly des- <br /> cribed as follows: <br /> All of Blocks 13, 14, 17 , 18, 27 , 28 , 31, and <br /> 42, less a portion of Block 1 described as <br /> follows: All in Sines Acre Tracts, beginning <br /> at the SE corner of Block 31; thence W 79 feet; <br /> thence northeasterly on a radius of 1,860 feet <br /> for 407 .5 feet to NE corner of said block; thence <br /> S to point of beginning; <br /> and all land leased by the City of Everett from the Northern <br /> Pacific Railway Company contiguous with the above-described <br /> real property. Further, it is necessary to provide for the <br /> propert maintenance of health and sanitation control in the <br /> City of Everett. That said disposal site be operated as a <br /> sanitary landfill; and it is further necessary for the City <br /> of Everett to provide for the handling of the delivery of <br /> waste material to said disposal site. <br /> Section 2: Definitions. The following definitions <br /> of terms as used in this ordinance shall apply in the en- <br /> forcement and application thereto, to-wit: <br /> (a) "Waste" shall be taken to mean all put- <br /> recible and non-putrecible waste from all public <br /> or private dwellings and establishments and except <br /> carcasses of dead animals, including, but not <br /> limited to, all garbage, waste, rubbish, debris, <br /> discarded food, swill, animal and vegetable matter, <br /> waste papers, cans, glass, ashes, offal, boxes , <br /> brush, shrubs, and garden leaves, unattached por- <br /> tions of trees, bushes or shrubs, and refuse, except <br /> sewage from all public or private dwellings and <br /> establishments and except carcasses of dead animals. <br /> -1- ORDINANCE <br />
