M. , and <br /> recorded in Volume of Plats, on Page Records <br /> of Snohomish County, Washington. <br /> Snohomish County Auditor <br /> Deputy County Auditor <br /> SECTION 8. Modifications and Variations. <br /> Any subdivider can make application to the Planning Commission <br /> requesting a modification or variation of any provision within the <br /> Subdivision Regulations. The justification for a modification or <br /> ►ariation must be due to pre-existing, topographic, or other <br /> physical conditions characteristic of the land included in the <br /> proposed plat. The application shall be considered by the Planning <br /> Commission during the hearing on the proposed plat. Before <br /> granting a modification or variation, the Planning Commission <br /> shall first determine that a hardship would be incurred by the sub- <br /> divider if he complied to the stric t application of the Regulations <br /> and that this hardship would exist for any other person who would <br /> subdivide the same area of land. The Planning Commission shall <br /> request a written opinion from the City Engineer, before any <br /> modification or variation is granted. <br /> SECTION 9. Sales Before A Plat Is Approved and Filed--Penalty.- <br /> Civil Remedies. <br /> Any person who shall violate any of the provisions of this ordinance <br /> hereby adopted or who shall fail to comply with any of the provisions <br /> herein contained shall be guilty of a violation of this ordinance for <br /> each and ev ery violation and non-compliance, and shall be punished <br /> by a fine of not more than $300. 00 or by imprisonment for not more <br /> than 90 days in the City Jail or by both such fine and imprisonment. <br /> The imposition of one penalty for a violation shall not excuse the <br /> violation or permit it to continue and all such persons who shall <br /> continue in violation of the sections of this ordinance shall be deemed <br /> guilty of a separate offense after the lapse of ten (10) days and the <br /> continuance of such violation. <br /> (17) <br />
