• <br /> a w • <br /> ♦ The application of the above penalty by what ever action the City <br /> of Everett shall take shall not be held to prevent the civil remedies <br /> herein provided. <br /> In addition to the criminal penalties hereinabove provided, the City <br /> of Everett shall have the following civil remedies to-wit: <br /> The owner or agent of the owner of land located in a plat or <br /> subdivision who transfers or sells or agrees to sell or option <br /> any land by reference to or exhibition of or by any other use <br /> of a plat or map of a subdivision before it has been approved <br /> and filed as in this ordinance provided, shall forfeit and pay <br /> a penalty of $100. 00 for each lot or parcel so transferred or <br /> sold or agreed or optioned to be sold. The description of the <br /> lot by metes and bounds in the instrument of transfer agreeing <br /> or optioning or conveying shall not exempt the transaction from <br /> the penalty or from the remedies herein provided. In the <br /> alternative, the City of Everett, upon a decision of the City <br /> Council, may elect to enjoin the transfer, sale agreement, or <br /> option, by action in the Superior Court. Decision by the City <br /> Council to seek one or the other of said civil remedies shall <br /> be exclusive of the other. <br /> SECTION 10. Conflict. <br /> Ordinance No. 814 and all ordinances in conflict herewith are <br /> hereby repealed. <br /> SECTION 11. Validity. <br /> Should any section, subsection, paragraph, sentence, clause, or <br /> phrase of this Ordinance be declared unconstitutional or invalid <br /> for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance. /J <br /> A.
