<br /> • • h. Proposed Plat is a preliminary plan of the plat, subdivision,
<br /> or deet-',:-:,.tion centainirg the elements and requirements as set
<br /> forth i this ordinance,
<br /> 1. Subdivider is any person, firm or corporation proposing to make,
<br /> or have made a subdivison.
<br /> j. Subdivision is an area of land which has been divided into lots,
<br /> plots, tracts, or other divisions of land, and may or may not
<br /> include a map, or maps, relating thereto, for the purpose,
<br /> whether immediate or future, of transfer of ownership, or for
<br /> building developments, including all designations in street lines,
<br /> public area boundaries, lot lines, easements, rights of way,
<br /> pavement widths, curb lines, location and size of utilities,
<br /> location and size of land area to be dedicated; provided that this
<br /> definition of a subdivision shall not be including those divisions
<br /> of land kr agricultural purposes,.:where each parcel is five
<br /> acres or more in area and which does not include new streets,
<br /> easements, rights of way, or other provisions for necessary
<br /> public areas and facilities.
<br /> k. Tentative Approval is the official action taken on the proposed
<br /> plat, subdivision, or dedication by the Planning Commission,
<br /> meeting in official session.
<br /> SECTION 4. Control of Plats, Subdivisions, or Dedications.
<br /> The platting and subdividing of land into lots, or tracts comprising
<br /> five or more such lots or tracts, or containing a dedication of any
<br /> part thereof as a public street or highway, is required to proceed
<br /> under and in compliance with the provisions of the State Laws and
<br /> this ordinance; provided that the subdivider shall not proceed with
<br /> any construction work upon the proposed lots of the proposed plat,
<br /> including grading or excavating of such lots, until he or it has obtained
<br /> from the City Council final approval in accordance with this Subdivision
<br /> Ordinance, except that the improvements on proposed rights of way or
<br /> easements to be made after filing of the tentative plat, as herinafter
<br /> provided, may proceed after receipt of tentative approval.
<br /> SECTION 5. Authority for Granting Approval of Plats, Subdivisions,
<br /> and Dedications.
<br /> Each plat, subdivision, or dedication, before any of its lots or tracts
<br /> may be sold or offered for sale, shall be submitted for approval to
<br /> the City Council, and no sale or offer for sale shall be made until
<br /> it has the written and final approval of the City Council shown
<br /> thereon and until it is filed for record with the County Auditor.
