Marco Spani <br />SPU 7-90 <br />Page -7- <br />2. Pursuant to the p-ovisions of EZC, Section 41.150.D, a Special Property <br />Use Permit is required. <br />3. The criteria for Special Property Use Permits are set forth in EZC <br />41.150.C. Theme criteria have been addressed in the findings and they <br />are satisfied by the proposal of the Applicant. <br />4. In order to locate a governmental office in the area outside of the B-3 <br />zone located south of Everett Avenue and north of Pacific Avenue, the <br />criteria of EZC 41.150.D.1.a must be satisfied. The criteria are <br />satisfied. Reference is made to the findings as to the manner in which <br />the criteria are satisfied. <br />5. Adequate parking exists on -site. However, review of the parking <br />analysis must occur to determine what other alternatives are available. <br />DECISION <br />Based upon the preceding findings of facts and conclusions, the testimony and <br />evidence submitted at the public hearing, and upon the impressions of the <br />Everett Hearing Examiner of a site view, it is hereby ordered that the Special <br />Property Use Permit for the allowance of the lease of 10,000 square feet of an <br />existing 24,000 square foot building by the Washington State Department of <br />Revenue 's granted. The Special Property Use Permit is granted to allow the <br />use of Lae building at 4201 Rucker Avenue, Everett, to be used for such <br />purposes even though it is outside the B-3, Central Business District zone and <br />the area south of Everett Avenue and north of Pacific Avenue. This Special <br />Property Use Permit is granted subject to the following conditions: <br />1. Occupancy of the building at 4201 Rucker Avenue shall be limited to 36 <br />employees of the Washington State Department of Revenue, as proposed by <br />the Applicant. <br />2. The area occupied by the Washington State Department of Revenue shall be <br />limited to 10,000 square feet, which shall be more specifically defined <br />by the Applicant. This area shall provide for future growth of the <br />Washington State Department of Revenue to 36 employees. Any further <br />development in the building will require further review by the City of <br />Everett. <br />3. After two months of occupancy by the Washington State Department of <br />Revenue, the Applicant shall submit a parking analysis to the Planning <br />Department. The parking analysis must include actual parking counts on <br />the site and available parking spaces on adjacent public right-of-ways <br />during specific periods throughout the day. These periods shall include <br />parking available at 8:30 a.m., 10:30 a.m., 12:30 p.m., and 3:00 p.m. <br />If the study shows that adequate parking is not available, the Applicant <br />must provide additional off -site parking in conformance with EZC <br />34.060. As an alternative, the Applicant can demonstrate that it will <br />provide a carpool, vanpool, or transit incentive program for the <br />employees. However, proof must be shown that there is use of these <br />alternatives. <br />
