7. Towers associated with above ground utility and communications facilities and all <br />ancillary structures shall comply with the setback of the zone in which the property <br />Is located. <br />Findinq: No new tower is proposed. The equipment complies with the setbacks for the <br />underlying zone. <br />8. The a6ove flround utiiity or communication facility shall be removed from the site <br />should the use for such purposes be discontinued for 120 days of more. <br />Findinp: T-Mobile will remove the facilily if use of ihe site is discontinued for 12(' days or more. <br />9. Maintenance or replacement of existing utility or communications facilities, and the <br />installation of new utility poles, Ifght poles or standards, switch cabinets, pad <br />mount transformers or other similar utility of communications facilities c` a minor <br />nature and small scale are exempt from this section. <br />Findin : Tliis modificalion includes the addition of ihree (3) antennas to a replacement facility, <br />and is within the 20-foot limit allowed by lhe EMC. <br />10. To the extent provided by law, the City may require utiiity or communications <br />service provider to allow up to two additional service providers to be Iocated on <br />shared facilities to discourage the proliferation of tower structures, consistent <br />with technological feasibility. The review authority may allow an additional 20 feet <br />in tower height per additicnal provider to accommodate coilocation. <br />Findin : N!A <br />11. Utility or communication facilities which require towers forwhich safety lights are <br />required by the FAA shail not be permitted unless the applicant demonstrates that <br />such a facility in the proposed location and at such a height is necessary to <br />adequatety serve the needs of the public for ihe proposed utility or communications <br />service. <br />Finding: There is no lighling required by :he FAA. <br />12. The Pianning Director may require review by an expert third party. <br />Findin : This project will not reyuire an independent techcical analysis of ihe subjecl <br />appiication. <br />DECISION: <br />The Planning Director in accordance witli Section 41.150C of the Everett Municipal <br />Code has approved a wireless communications faciliry at 1927 West Mukilteo <br />Boulevard in Everett, Washington subject to the foilowing condition: <br />1) The applicant must obtain Buiiding and Electricai Permits from the Everett <br />Buiidi�g Department. <br />
