I 1 Division 1 111 2 General Requirements 3 I 4 5 1-01 Definition and Terms 6 7 1-01.3 Definitions 8 Section 1-01.3 is amended by adding the following: 9 I 10 All references in the Standard Specifications to the terms "State", "Department of 11 Transportation", "Washington State Transportation Commission", "Commission", "Secretary 12 of Transportation", "Secretary", "Headquarters", and "State Treasurer" shall be revised to 13 read "Contracting Agency". 14 15 All references to "State Materials Laboratory" shall be revised to read "Contracting Agency 16 designated location". I 17 18 The venue of all causes of action arising from the advertisement, Award, execution, and 19 performance of the Contract shall be in the Superior Court of the County where the I 20 Contracting Agency's headquarters are located. 21 22 Additive: A supplemental unit of Work or group of Bid items, identified separately in the I 23 Proposal, which may, at the discretion of the Contracting Agency, be awarded in addition to 24 the Base Bid. 25 Alternate: One of two or more units of Work or groups of Bid items, identified separately in I 26 the Proposal, from which the Contracting Agency may make a choice between different 27 methods or material of construction for performing the same Work. 28 Award Date: The date of the formal action by the Everett City Council to accept the lowest 29 responsible and responsive Bidder for the Work. 30 Bid Opening Date: The date on which the Everett City Clerk publicly opens and reads the 31 Bids. 32 Change Order: Reference to Change Order shall include all rights of the Owner and 33 Contractor under Section 1-04.4 Changes. Agreed Change Orders shall be in the form 34 included in Appendix E. Unilateral Change Orders shall be in the form for that purpose, 35 included in Appendix E. 36 Completion Date: Date on which Project is ready for Final Acceptance. All physical Work, 37 including Punch List, is complete and the Contractor has completed and fulfilled all 38 contractual obligations except any maintenance of landscaping. Contractual obligations 39 that must be fulfilled prior to achievement of the Completion Date include, but are not 40 limited to, the Contractor's furnishing all documentation (including correct, complete and 41 accurate as-built or record drawings) and operation and maintenance manuals and transfer 42 of warranties. 43 Contract Claim: Any request by the Contractor for additional time or money (adjustment of 44 Contract Sum or Contract Time) irrespective of the cause or reason for the request. 45 Contract Claims include, but are not limited to, requests by the Contractor for additional 46 time or money due to Extra Work, inefficiencies, delays, interferences, and problems with 47 the design.
