I <br /> 1 1 Subcontractors for extensions of Contract Time, adjustment of Contract Sum, additional <br /> 2 compensation that the Contractor attempts to pass through or assert against the Owner, or <br /> I 3 claims against the Owner arising out of a third party's claim against the Contractor. <br /> 4 Contract Documents: See form of Contract in the Bid Proposal. <br /> 5 Contract Time: The period of time established by the terms and conditions of the Contract <br /> I 6 within which the Work must be physically completed. <br /> 7 Contract Execution Date: The date the City of Everett officially binds the Contractor to the <br /> I 8 Contract. <br /> 9 Contract Sum: The price in dollars stated in the Contract to be paid by the Owner to the <br /> 10 Contractor for the Work described in the Contract Documents, as modified by any Change <br /> 11 Orders. <br /> 12 Delay: Any increase of the duration of the critical path of the Project. <br /> Dispute: Any controversy or disagreement. <br /> I13 <br /> 14 Engineer: Any and all provisions in the Contract Documents that state the Engineer "shall" <br /> 15 or "will" shall be deemed to mean that the Engineer shall or will take such action if <br /> 16 requested in writing by the Contractor. <br /> I17 Equipment: Mechanical, electrical, instrumentation, or other devices with one or more <br /> 18 moving parts, or devices requiring an electrical, pneumatic, electronic, or hydraulic <br /> I 19 connection. <br /> 20 Extended Overhead: The increase in Overhead costs attributable to an extension of <br /> 21 Contract Time. <br /> 22 Extra Work: Providing materials and Equipment and the performance of Work not directly <br /> 23 called for in, or implied by, the Contract Documents, such that the Contractor would be <br /> 24 entitled to an adjustment of Contract Sum and possibly an extension of Contract Time. <br /> I25 Final Acceptance: Formal action by Everett City Council determining that all of the <br /> 26 Contractor's Work has been completed, except for any landscaping maintenance. <br /> I 27 Float: The amount of time between the early start date and the late start date, or the early <br /> 28 finish date and the late finish date of any activity in the Project schedule. <br /> 29 Force Account: Costs of performing Work as defined in Section 1-09.6 Force Account. <br /> I 30 Furnish: To deliver to the job site or other specified location any item, Equipment, or <br /> 31 material. <br /> 32 Install: Placing, erecting, or constructing complete in place any item, Equipment, or <br /> I33 material. <br /> 34 May: Conduct that is permitted, but not required. <br /> I 35 Notice: A signed, written communication by the Contractor to the Owner as described in <br /> 36 Section 1-04.5 Notice by Contractor. <br /> 37 Notice of Award: The written notice from the City of Everett to the successful Bidder <br /> I38 signifying the City's acceptance of the Bid. <br /> 39 Notice to Proceed: The written Notice from the Owner or Owner's Representative to the <br /> 40 Contractor authorizing and directing the Contractor to proceed with the Work and <br /> I 41 establishing the date on which the Contract Time begins.
