I <br /> 111 1 1-03 Award and Execution of Contract <br /> 2 <br /> 3 1-03.1 Consideration of Bids I <br /> 4 The first paragraph is modified to read as follows: <br /> 5 <br /> 6 After opening and reading Proposals, the Contracting Agency will check them for <br /> 7 correctness of extensions of the prices per unit and the total price. If a discrepancy exists <br /> 8 between the price per unit and the extended amount of any Bid item, the price per unit will <br /> 9 control. If a minimum Bid amount has been established for any item and the Bidder's unit or <br /> 10 lump sum price is less than the minimum specified amount, the Contracting Agency willIII <br /> 11 unilaterally revise the unit or lump sum price, to the minimum specified amount and <br /> 12 recalculate the extension. The total of extensions, corrected where necessary, including <br /> 13 sales taxes where applicable and such additives and/or alternates as selected by the I <br /> 14 Contracting Agency, will be used by the Contracting Agency for Award purposes and to fix <br /> 15 the awarded Contract price amount and the amount of the Contract Bond. <br /> 16 <br /> 17 1-03.3 Execution of Contract <br /> 18 Section 1-03.3 is amended by adding the following: <br /> 9 <br /> 2 <br /> 20 The Contractor is required to possess a City business license prior to Award. <br /> 21 <br /> 22 The successful Contractor shall obtain two (2) copies of the Contract provisions from the <br /> 23 City Engineer after the Project has been awarded by City Council. These documents will <br /> 24 have been prepared by the City Clerk, Sharon Fuller (425-257-8610) for execution of the <br /> 25 Contract. The Contractor shall promptly execute and return both signed copies of the <br /> 26 prepared Contract together with an insurance certificate and additional insured I 27 endorsement as required by Section 1-07.18 and a satisfactory bond as required by law <br /> 28 and Section 1-03.4. The City will forward one (1) copy of the fully executed Contract to the <br /> 29 Contractor for its records and the City will retain the other. A Bid shall not be binding on the <br /> 30 City until the Contract has been fully executed by the City. <br /> 31 <br /> 32 1-03.4 Contract Bond <br /> 33 Supplement the first paragraph with the following: 11 <br /> 34 <br /> 35 6. Be accompanied by a power of attorney for the Surety's officer empowered to sign the <br /> 36 bond; and I <br /> 37 7. Be signed by an officer of the Contractor empowered to sign official statements (sole <br /> 38 proprietor or partner). If the Contractor is a corporation, the bond must be signed by the <br /> 39 president or vice-president, unless accompanied by written proof of the authority of the I <br /> 40 individual signing the bond to bind the corporation (i.e., corporate resolution, power of <br /> 41 attorney or a letter to such effect by the president or vice-president). <br /> 42 <br /> 43 1-03.7 Judicial Review <br /> 44 Section 1-0.7 is modified to read as follows: <br /> 45 <br /> 46 Any decision made by the Contracting Agency regarding the Award and execution of the <br /> 47 Contract or Bid rejection shall be conclusive subject to the scope of judicial review <br /> 48 permitted under Washington Law.
