I <br /> I1 the scope of Work and making any adjustments to the Contract Sum pursuant to Section 1- <br /> 2 09.4 Equitable Adjustment and Contract Time in such amount and for such time as the <br /> I <br /> 3 <br /> 4 Owner thinks appropriate. The Contractor agrees to use the agreed Change Order form <br /> attached to the Contract Documents. The Contractor accepts all requirements, terms and <br /> 5 conditions of a Change Order by: signing it; writing a separate acceptance; or by failing to <br /> I <br /> 6 <br /> 7 notify the Owner immediately in writing that Contractor disagrees with the Change Order <br /> and does not intend to be bound by its terms. <br /> 8 <br /> 9 The Contractor waives and is estopped from denying its agreement with any unilateral <br /> I 10 Change Order for which the Contractor does not immediately give Notice to the Owner as <br /> 11 provided in Section 1-04.5 Notice by Contractor and submitting a Contract Claim as <br /> 12 provided in Section 1-09.11(2) Claims. A unilateral Change Order that is not timely <br /> I 13 protested as provided in this Section shall be full payment and final settlement of all <br /> 14 asserted and unasserted Contract Claims for Contract Time and all costs of any kind, <br /> 15 including costs of Delays, inefficiencies and impacts, related to, arising out of, or resulting <br /> I <br /> 16 from, any Work described in the Change Order. <br /> 17 <br /> 18 The Contractor shall obtain written consent of the Surety or Sureties if the Owner's <br /> 19 Representative requests such consent. <br /> I 20 <br /> 21 1-04.4(1) Minor Changes <br /> 22 Section 1-04.4(1) is supplemented with the following: <br /> I 23 <br /> 24 Unexpected Site Changes <br /> 25 Payments or credits for changes amounting to $15,000 or less may be made under the <br /> I 26 Bid item "Unexpected Site Changes". At the discretion of the Contracting Agency, this <br /> 27 procedure for Unexpected Site Changes may be used in lieu of the more formal <br /> 28 procedure as outlined in Section 1-04.4, Changes. <br /> 29 <br /> 30 The Contractor will be provided a copy of the completed order for Unexpected Site <br /> 31 Changes. The agreement for the Unexpected Site Changes will be documented by <br /> 32 signature of the Contractor, or notation of verbal agreement. If the Contractor is in <br /> I 33 disagreement with anything required by the order for Unexpected Site Changes, the <br /> 34 Contractor may protest the order as provided in Section 1-04.5. <br /> 35 <br /> I 36 <br /> 37 Payments will be determined in accordance with Section 1-09.6. For the purpose of <br /> providing a common Proposal for all Bidders, the Contracting Agency has entered an <br /> 38 amount for "Unexpected Site Changes" in the Proposal to become a part of the total <br /> 39 Bid by the Contractor. Credits will be determined in accordance with Section 1-09.4. <br /> ' <br /> 40 <br /> 41 1-04.4(2) Value Engineering Change Proposal <br /> 42 Section 1-04.4(2) is modified to read as follows: <br /> I <br /> 43 <br /> 44 1-04.4(2) Value Engineering and Cost Sharing <br /> 45 The Contractor may submit Proposals for changing the Plans, Specifications, or other <br /> I 46 requirements of the Contract Documents and the Owner, in its sole discretion, may accept <br /> 47 or reject such Proposals. If accepted by the Owner and if the Proposal decreases the <br /> 48 direct, actual costs of constructing the Work, the Contract Sum shall be reduced by fifty <br /> 49 percent (50%) of the direct, actual construction cost saved.
