I I1 the scope of Work and making any adjustments to the Contract Sum pursuant to Section 1- 2 09.4 Equitable Adjustment and Contract Time in such amount and for such time as the I 3 4 Owner thinks appropriate. The Contractor agrees to use the agreed Change Order form attached to the Contract Documents. The Contractor accepts all requirements, terms and 5 conditions of a Change Order by: signing it; writing a separate acceptance; or by failing to I 6 7 notify the Owner immediately in writing that Contractor disagrees with the Change Order and does not intend to be bound by its terms. 8 9 The Contractor waives and is estopped from denying its agreement with any unilateral I 10 Change Order for which the Contractor does not immediately give Notice to the Owner as 11 provided in Section 1-04.5 Notice by Contractor and submitting a Contract Claim as 12 provided in Section 1-09.11(2) Claims. A unilateral Change Order that is not timely I 13 protested as provided in this Section shall be full payment and final settlement of all 14 asserted and unasserted Contract Claims for Contract Time and all costs of any kind, 15 including costs of Delays, inefficiencies and impacts, related to, arising out of, or resulting I 16 from, any Work described in the Change Order. 17 18 The Contractor shall obtain written consent of the Surety or Sureties if the Owner's 19 Representative requests such consent. I 20 21 1-04.4(1) Minor Changes 22 Section 1-04.4(1) is supplemented with the following: I 23 24 Unexpected Site Changes 25 Payments or credits for changes amounting to $15,000 or less may be made under the I 26 Bid item "Unexpected Site Changes". At the discretion of the Contracting Agency, this 27 procedure for Unexpected Site Changes may be used in lieu of the more formal 28 procedure as outlined in Section 1-04.4, Changes. 29 30 The Contractor will be provided a copy of the completed order for Unexpected Site 31 Changes. The agreement for the Unexpected Site Changes will be documented by 32 signature of the Contractor, or notation of verbal agreement. If the Contractor is in I 33 disagreement with anything required by the order for Unexpected Site Changes, the 34 Contractor may protest the order as provided in Section 1-04.5. 35 I 36 37 Payments will be determined in accordance with Section 1-09.6. For the purpose of providing a common Proposal for all Bidders, the Contracting Agency has entered an 38 amount for "Unexpected Site Changes" in the Proposal to become a part of the total 39 Bid by the Contractor. Credits will be determined in accordance with Section 1-09.4. ' 40 41 1-04.4(2) Value Engineering Change Proposal 42 Section 1-04.4(2) is modified to read as follows: I 43 44 1-04.4(2) Value Engineering and Cost Sharing 45 The Contractor may submit Proposals for changing the Plans, Specifications, or other I 46 requirements of the Contract Documents and the Owner, in its sole discretion, may accept 47 or reject such Proposals. If accepted by the Owner and if the Proposal decreases the 48 direct, actual costs of constructing the Work, the Contract Sum shall be reduced by fifty 49 percent (50%) of the direct, actual construction cost saved.
