I 1 the Work to be performed by the Contractor. In either case, the cost of the Work I 2 incurred by or charged to the Contractor will be included in a Change Order. 3 4 I 5 1-04.4 Changes 6 Delete Section 1-04.4 and substitute the following: 7 8 9 1-04.4 Changes 10 11 City's Right to Direct Changes to the Work 12 The City reserves the right to change the Work at any time. Such changes shall not 13 invalidate the Contract nor release the Surety, and the Contractor agrees to perform the 14 Work as changed.Among others, these changes and alterations may include: 15 16 1. Deleting or omit any part of the Work, Equipment and/or material to be provided 17 under this Contract, and 18 2. Increasing or decreasing quantities, 19 3. Altering Specifications, designs, or both, I 20 4. Altering the way the Work is to be done, 21 5. Adding new Work or extra Work, 22 6. Altering facilities, Equipment, materials, services, or sites, provided by the I 23 Contracting Agency, and 24 7. Ordering the Contractor to accelerate or delay Work. 25 I 26 If the Contractor and Owner do not agree upon scope of Work changed or adjustment to 27 the Contract Sum and Contract Time, the Owner may, at its sole option, unilaterally direct 28 the Contractor to implement any change by Notice. The Owner shall not pay or be I 29 responsible or liable for any change implemented by the Contractor without explicit Notice 30 from the Owner to proceed. 31 I 32 Extra Work 33 At its sole option, the Owner may (1) perform Extra Work itself, (2) employ others to do it, 34 (3) direct the Contractor to perform the Extra Work at existing unit Bid price, (4) direct the I 35 Contractor to perform the Extra Work at a mutually agreed upon price, or (5) direct the 36 Contractor to perform the Extra Work on a Force Account basis. 37 38 Change Orders I 39 Changes to the Work may result in an increase or decrease in Contract Sum, as provided 40 in Section 1-09.4 Equitable Adjustment. Requests for an increase in Contract Time must be 41 made as provided in Section 1-08.3 Progress Schedule, as applicable. Substantial 42 changes in Contract Time, Contract Sum or Work will often be negotiated and agreed 43 between the Contractor and Owner before the Owner directs the Contractor to proceed with 44 the change.
