I <br /> 1 the Work to be performed by the Contractor. In either case, the cost of the Work I <br /> 2 incurred by or charged to the Contractor will be included in a Change Order. <br /> 3 <br /> 4 I <br /> 5 1-04.4 Changes <br /> 6 Delete Section 1-04.4 and substitute the following: <br /> 7 <br /> 8 <br /> 9 1-04.4 Changes <br /> 10 <br /> 11 City's Right to Direct Changes to the Work <br /> 12 The City reserves the right to change the Work at any time. Such changes shall not <br /> 13 invalidate the Contract nor release the Surety, and the Contractor agrees to perform the <br /> 14 Work as changed.Among others, these changes and alterations may include: <br /> 15 <br /> 16 1. Deleting or omit any part of the Work, Equipment and/or material to be provided <br /> 17 under this Contract, and <br /> 18 2. Increasing or decreasing quantities, <br /> 19 3. Altering Specifications, designs, or both, <br /> I <br /> 20 4. Altering the way the Work is to be done, <br /> 21 5. Adding new Work or extra Work, <br /> 22 6. Altering facilities, Equipment, materials, services, or sites, provided by the <br /> I <br /> 23 Contracting Agency, and <br /> 24 7. Ordering the Contractor to accelerate or delay Work. <br /> 25 <br /> I <br /> 26 If the Contractor and Owner do not agree upon scope of Work changed or adjustment to <br /> 27 the Contract Sum and Contract Time, the Owner may, at its sole option, unilaterally direct <br /> 28 the Contractor to implement any change by Notice. The Owner shall not pay or be <br /> I <br /> 29 responsible or liable for any change implemented by the Contractor without explicit Notice <br /> 30 from the Owner to proceed. <br /> 31 I 32 Extra Work <br /> 33 At its sole option, the Owner may (1) perform Extra Work itself, (2) employ others to do it, <br /> 34 (3) direct the Contractor to perform the Extra Work at existing unit Bid price, (4) direct the <br /> I <br /> 35 Contractor to perform the Extra Work at a mutually agreed upon price, or (5) direct the <br /> 36 Contractor to perform the Extra Work on a Force Account basis. <br /> 37 <br /> 38 Change Orders I <br /> 39 Changes to the Work may result in an increase or decrease in Contract Sum, as provided <br /> 40 in Section 1-09.4 Equitable Adjustment. Requests for an increase in Contract Time must be <br /> 41 made as provided in Section 1-08.3 Progress Schedule, as applicable. Substantial <br /> 42 changes in Contract Time, Contract Sum or Work will often be negotiated and agreed <br /> 43 between the Contractor and Owner before the Owner directs the Contractor to proceed with <br /> 44 the change. ' <br /> 45 <br /> 46 If the Contractor and Owner agree on the scope of Work and any changes to Contract Sum <br /> 47 and Contract Time, the Contractor and Owner shall execute an agreed Change Order. <br /> 48 However, if the Contractor and Owner do not agree, the Owner may, in its sole discretion, <br /> I <br /> 49 issue a unilateral Change Order in the form attached to the Contract Documents changing <br /> City of Everett Page SP1-14 Special Provisions I Everett Station 80 Stall Parking Expansion June 2019 <br />
