I 111 1 the Work. The City also has the authority to accept or reject the City's Representative's 2 recommendations regarding retention of defective Work. I 3 4 1-05.2 Authority of Assistants and Inspectors 5 Delete Section 1-05.2 and substitute the following: I 6 7 1-05.2 City's Representative 8 9 The City's Representative shall be satisfied that all the Work is being done in accordance I10 with the requirements of the Contract. The Contract and Specifications give the City's 11 Representative authority over the Work. Whenever it is so provided in this Contract, the 12 decision of the City's Representative shall be final. I 13 14 The City's Representative's decisions will be final on all questions including, but not limited 15 to, the following: I 16 17 1. Quality and acceptability of materials and Work; 18 2. Measurement of Work, whether lump sum, Force Account, or unit price; 19 3. Acceptability of rates of progress on the Work; 20 4. Interpretation of Plans and Specifications; 21 5. Determination as to the existence of changed or differing site conditions; 22 6. Fulfillment of the Contract by the Contractor; 23 7. Payments under the Contract including adjustment; 24 8. Suspension(s) of Work; I25 9. Termination of the Contract for default or public convenience; and 26 10. Approval of working or detail drawings and Submittals. I 27 28 If the Contractor fails to respond promptly to the requirements of the Contract or orders 29 from the Owner's Representative: 30 I 31 1. The Owner's Representative may use the Owner's resources, other Contractors, or 32 other means to accomplish the Work, and 33 2. The City will not be obligated to pay the Contractor, and will deduct from the I 34 Contractor's payments, any costs that result when any other means are used to 35 carry out the Contract requirements or City's Representative's orders. 36 I 37 At the Contractor's risk, the City's Representative may suspend all or part of the Work if: 38 39 1. The Contractor fails to fulfill Contract terms, to carry out the City's Representative's I40 orders, or to correct unsafe conditions of any nature; or 41 2. It is in the public interest. 42 43 The City's Representative and City shall have complete access to the Work and to the site I44 of the Work and to the places where Work is being prepared or where materials, 45 Equipment, and machinery are being obtained for the Work. If requested by the City's 46 Representative or City, the Contractor shall provide the assistance necessary for obtaining 1 47 such access, and shall provide information related to the inspection of construction.
