The City also has the authority to accept or reject the City's Representative's <br /> 2 recommendations regarding retention of defective Work. <br /> I 3 <br /> 4 1-05.2 Authority of Assistants and Inspectors <br /> 5 Delete Section 1-05.2 and substitute the following: <br /> I 6 <br /> 7 1-05.2 City's Representative <br /> 8 <br /> 9 The City's Representative shall be satisfied that all the Work is being done in accordance <br /> I10 with the requirements of the Contract. The Contract and Specifications give the City's <br /> 11 Representative authority over the Work. Whenever it is so provided in this Contract, the <br /> 12 decision of the City's Representative shall be final. <br /> I 13 <br /> 14 The City's Representative's decisions will be final on all questions including, but not limited <br /> 15 to, the following: <br /> I 16 <br /> 17 1. Quality and acceptability of materials and Work; <br /> 18 2. Measurement of Work, whether lump sum, Force Account, or unit price; <br /> 19 3. Acceptability of rates of progress on the Work; <br /> 20 4. Interpretation of Plans and Specifications; <br /> 21 5. Determination as to the existence of changed or differing site conditions; <br /> 22 6. Fulfillment of the Contract by the Contractor; <br /> 23 7. Payments under the Contract including adjustment; <br /> 24 8. Suspension(s) of Work; <br /> I25 9. Termination of the Contract for default or public convenience; and <br /> 26 10. Approval of working or detail drawings and Submittals. <br /> I 27 <br /> 28 If the Contractor fails to respond promptly to the requirements of the Contract or orders <br /> 29 from the Owner's Representative: <br /> 30 <br /> I <br /> 31 1. The Owner's Representative may use the Owner's resources, other Contractors, or <br /> 32 other means to accomplish the Work, and <br /> 33 2. The City will not be obligated to pay the Contractor, and will deduct from the <br /> I 34 Contractor's payments, any costs that result when any other means are used to <br /> 35 carry out the Contract requirements or City's Representative's orders. <br /> 36 <br /> I <br /> 37 At the Contractor's risk, the City's Representative may suspend all or part of the Work if: <br /> 38 <br /> 39 1. The Contractor fails to fulfill Contract terms, to carry out the City's Representative's <br /> I40 orders, or to correct unsafe conditions of any nature; or <br /> 41 2. It is in the public interest. <br /> 42 <br /> 43 The City's Representative and City shall have complete access to the Work and to the site <br /> I44 of the Work and to the places where Work is being prepared or where materials, <br /> 45 Equipment, and machinery are being obtained for the Work.
