I <br /> 1 I <br /> 2 Copies of these field notes shall be provided to the Engineer upon request and upon <br /> 3 completion of the Contract Work; the field book shall be submitted to the Engineer and <br /> I <br /> 4 become property to the Contracting Agency. <br /> 5 <br /> 6 If the survey Work provided by the Contractor does not meet the standards of the Engineer, I 7 then the Contractor shall, upon the Engineer's written request, remove the individual or <br /> 8 individuals doing the survey Work and the survey Work will be completed by the Engineer <br /> 9 at the Contractor's expense. Costs for completing the survey Work required by the <br /> I <br /> 10 Engineer will be deducted from monies due or to become due the Contractor. <br /> 11 <br /> 12 The City may spot-check the Contractor's surveying. These spot-checks will not change <br /> 13 the requirements for normal checking and testing as described elsewhere, and do not I 14 relieve the Contractor of the responsibility of producing a finished product that is in <br /> 15 accordance with the Contract. <br /> 16 1 17 In all disputes concerning accuracy of lines and elevations, the City shall be assumed <br /> 18 correct and the Contractor shall correct the discrepancies before construction Work may <br /> 19 proceed. No additional compensation will be paid for this corrective Work. <br /> 20 <br /> 1 <br /> 21 Payment <br /> 22 The lump sum Contract price for "Surveying" shall be full pay for all costs involved in <br /> 23 furnishing all labor, tools, survey instruments, materials, and other equipment necessary for <br /> I <br /> 24 the setting and maintaining of the alignment and grade as specified. <br /> 25 <br /> 26 1-05.6 Inspection of Work and Materials <br /> I <br /> 27 Supplement Section 1-05.6 by adding the following: <br /> 28 <br /> 29 1-05.6(1) Demonstration of Compliance with Contract Requirements <br /> I <br /> 30 The burden of proving the constructed Work complies with the Contract Documents shall <br /> 31 be on the Contractor at all times. The Contractor shall grant the City's Representative <br /> 32 access to the Work and Work site and to places where Work is being prepared, or where <br /> 33 materials, Equipment, or machinery are being obtained for the Work. The Contractor shall <br /> I <br /> 34 provide information requested by the City's Representative in connection with inspection <br /> 35 Work. <br /> 36 <br /> I <br /> 37 If the Contract Documents, laws, ordinances, or public regulatory authority requires parts of <br /> 38 the Work to be specially inspected, tested, or approved, the Contractor shall give the City's <br /> 39 Representative be not less than two working days prior written Notice of the availability of <br /> I <br /> 40 the subject Work for examination. <br /> 41 <br /> 42 Inspection and quality control tests performed on the Contractor's Work by the City's <br /> 43 Representative shall not relieve the Contractor of its responsibility for errors or lack of <br /> I <br /> 44 quality therein and shall not be regarded as an assumption of risks or liability by the City's <br /> 45 Representative for the Contractor's compliance with these Contract Documents.
