I 1 The Contractor will not be allowed an extension of Contract Time because of a delay in I 2 the performance of the Work attributable to the exercise of the Engineer's right 3 hereunder. I 4 5 Upon correction of all deficiencies, the Engineer will notify the Contractor and the 6 Contracting Agency, in writing, of the date upon which the Work was considered I 7 physically complete. That date shall constitute the Physical Completion Date of the 8 Contract, but shall not imply acceptance of the Work or that all the obligations of the 9 Contractor under the Contract have been fulfilled. 10 I 11 1-05.11(3) Operational Testing 12 It is the intent of the Contracting Agency to have at the Physical Completion Date a 13 complete and operable system. Therefore when the Work involves the installation of I 14 machinery or other mechanical equipment; street lighting, electrical distribution or 15 signal systems; irrigation systems; buildings; or other similar Work it may be desirable 16 for the Engineer to have the Contractor operate and test the Work for a period of time I 17 after final inspection but prior to the Physical Completion Date. Whenever items of 18 Work are listed in the Contract Provisions for operational testing they shall be fully 19 tested under operating conditions for the time period specified to ensure their 20 acceptability prior to the Physical Completion Date. During and following the test I 21 period, the Contractor shall correct any items of workmanship, materials, or Equipment 22 which prove faulty, or that are not in first class operating condition. Equipment, 23 electrical controls, meters, or other devices and Equipment to be tested during this I 24 period shall be tested under the observation of the Engineer, so that the Engineer may 25 determine their suitability for the purpose for which they were installed. The Physical 26 Completion Date cannot be established until testing and corrections have been I 27 completed to the satisfaction of the Engineer. 28 29 The costs for power, gas, labor, material, supplies, and everything else needed to 30 successfully complete operational testing, shall be included in the unit Contract prices I 31 related to the system being tested, unless specifically set forth otherwise in the 32 Proposal. 33 I 34 Operational and test periods, when required by the Engineer, shall not affect a 35 manufacturer's guaranties or warranties furnished under the terms of the Contract. 36 37 1-05.12 Final Acceptance 38 Section 1-05.12 is modified to read as follows: 39 40 The Contractor must perform all the obligations under the Contract before the Completion I 41 Date can be established. A certificate of completion of the Work issued by the City will 42 establish the Completion Date and certify the Work as complete. The following must occur 43 before the Completion Date can be established: I 44 45 1. The Final Contract Voucher Certification must be signed by the Contractor verifying 46 agreement to the final Contract price. I 47 2. The physical Work on the Project must be complete. 48 3. The Contractor must furnish all documentation required by the Contract and 49 required by law, necessary to allow the City to certify the Contract as complete.
