I <br /> 1 The Contractor will not be allowed an extension of Contract Time because of a delay in I <br /> 2 the performance of the Work attributable to the exercise of the Engineer's right <br /> 3 hereunder. I 4 <br /> 5 Upon correction of all deficiencies, the Engineer will notify the Contractor and the <br /> 6 Contracting Agency, in writing, of the date upon which the Work was considered I 7 physically complete. That date shall constitute the Physical Completion Date of the <br /> 8 Contract, but shall not imply acceptance of the Work or that all the obligations of the <br /> 9 Contractor under the Contract have been fulfilled. <br /> 10 I 11 1-05.11(3) Operational Testing <br /> 12 It is the intent of the Contracting Agency to have at the Physical Completion Date a <br /> 13 complete and operable system. Therefore when the Work involves the installation of <br /> I <br /> 14 machinery or other mechanical equipment; street lighting, electrical distribution or <br /> 15 signal systems; irrigation systems; buildings; or other similar Work it may be desirable <br /> 16 for the Engineer to have the Contractor operate and test the Work for a period of time <br /> I <br /> 17 after final inspection but prior to the Physical Completion Date. Whenever items of <br /> 18 Work are listed in the Contract Provisions for operational testing they shall be fully <br /> 19 tested under operating conditions for the time period specified to ensure their <br /> 20 acceptability prior to the Physical Completion Date. During and following the test <br /> I <br /> 21 period, the Contractor shall correct any items of workmanship, materials, or Equipment <br /> 22 which prove faulty, or that are not in first class operating condition. Equipment, <br /> 23 electrical controls, meters, or other devices and Equipment to be tested during this I 24 period shall be tested under the observation of the Engineer, so that the Engineer may <br /> 25 determine their suitability for the purpose for which they were installed. The Physical <br /> 26 Completion Date cannot be established until testing and corrections have been <br /> I <br /> 27 completed to the satisfaction of the Engineer. <br /> 28 <br /> 29 The costs for power, gas, labor, material, supplies, and everything else needed to <br /> 30 successfully complete operational testing, shall be included in the unit Contract prices <br /> I <br /> 31 related to the system being tested, unless specifically set forth otherwise in the <br /> 32 Proposal. <br /> 33 <br /> I <br /> 34 Operational and test periods, when required by the Engineer, shall not affect a <br /> 35 manufacturer's guaranties or warranties furnished under the terms of the Contract. <br /> 36 <br /> 37 1-05.12 Final Acceptance <br /> 38 Section 1-05.12 is modified to read as follows: <br /> 39 <br /> 40 The Contractor must perform all the obligations under the Contract before the Completion <br /> I <br /> 41 Date can be established. A certificate of completion of the Work issued by the City will <br /> 42 establish the Completion Date and certify the Work as complete. The following must occur <br /> 43 before the Completion Date can be established: I 44 <br /> 45 1. The Final Contract Voucher Certification must be signed by the Contractor verifying <br /> 46 agreement to the final Contract price. I 47 2. The physical Work on the Project must be complete. <br /> 48 3.
