I 1 The City advises all General Contractors and Subcontractors that numerous Federal, State, 2 and local regulations exist that could affect the procedures used in the completion of this I 3 Project. The City advises each prospective Contractor that they are responsible to be 4 aware of and comply with all applicable statutes and regulations. It is recommended that 5 each Contractor contact the local office of the following agencies for a list of applicable I 6 regulations and requirements that might affect the implementation of this Project: 7 8 Federal Environmental Protection Agency 9 Washington Department of Health I 10 Washington Department of Ecology 11 Washington Department of Fisheries 12 Washington Department of Wildlife I 13 Washington Department of Labor & Industries 14 Puget Sound Air Pollution Control Agency 15 Municipal Building Department I 16 Municipal Planning Department 17 Municipal Public Works Department 18 19 If the scope of Work in this Contract includes Work at the City of Everett Water Filter Plant I20 or the Waste Water Pollution Control Facility, the Contractor must comply with the 21 requirements of the Washington Department of Labor & Industries for such Work including, 22 but not limited to, Chapter 296-67 WAC. All costs associated or incurred in complying with I 23 these regulations or any other regulations listed above are considered incidental to the 24 Contract and are included in the Contractor's Proposal. 25 I 26 27 In cases of conflict between different safety regulations, the more stringent regulation shall apply. 28 29 The Washington State Department of Labor and Industries shall be the sole and paramount 30 administrative agency responsible for the administration of the provisions of the 31 Washington Industrial Safety and Health Act of 1973 (WISHA). 32 I 33 The Contractor shall maintain at the Project site office, or other well-known place at the 34 Project site, all articles necessary for providing first aid to the injured. The Contractor shall 35 establish, publish, and make known to all employees, procedures for ensuring immediate I 36 removal to a hospital, or doctor's care, persons, including employees, who may have been 37 injured on the Project site. Employees should not be permitted to Work on the Project site 38 before the Contractor has established and made known procedures for removal of injured 39 persons to a hospital or a doctor's care. I 40 41 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of the 42 Contractor's plant, appliances, and methods, and for any damage or injury resulting from I 43 their failure, or improper maintenance, use, or operation. The Contractor shall be solely 44 and completely responsible for the conditions of the Project site, including safety for all 45 persons and property in the performance of the Work. This requirement shall apply I 46 continuously, and not be limited to normal working hours. The required or implied duty of 47 the Engineer to conduct construction review of the Contractor's performance does not, and 48 shall not, be intended to include review and adequacy of the Contractor's safety measures 49 in, on, or near the Project site.
