I 1 The Contractor shall pay all associated costs of providing each Manufacturer's Certificate of 2 Compliance submitted for City acceptance. 3 111 4 The City reserves the right to refuse to accept Equipment on the basis of a Manufacturer's 5 Certificate of Compliance. 6 7 Section 1-06.3(1) is added as follows: 8 9 1-06.3(1) Inspection Point at Manufacturing 10 The Contractor shall be responsible to reimburse the City for the costs of inspections at the 11 point of manufacturing for inspections occurring outside of Whatcom, Skagit, Island, 12 Snohomish, King, Pierce and Thurston counties. Costs to be paid or reimbursed by the 13 Contractor include, but are not limited to, travel, subsistence, labor and lodging expenses of 14 the City Inspector. 15 16 Point of manufacturing inspection will be required if: 17 18 Inspection and testing of materials or Equipment in the vicinity of the Work by the City 19 is not practicable, 20 21 The Contractor requests the City to inspect and test material or Equipment at the point 22 of manufacture, or 23 24 The Standard Specifications or these Special Provisions require that inspection, testing 25 or witnessing of tests take place at the point of manufacture. 26 27 1-06.4 Handling and Storing Materials 28 Supplement 1-06.4 by adding the following: 29 30 The Contractor shall store materials and Equipment so as to insure the preservation of their 31 quality and fitness for the Work. Stored Equipment and materials shall be located so as to 32 facilitate inspection. The Contractor shall be responsible for damages, loss or casualty 33 occurring to materials and Equipment until Final Acceptance. 34 35 36 1-07 Legal Relations and Responsibilities to the Public 37 38 1-07.1 Laws to be Observed 39 Section 1-07.1 is modified by adding the following: 40 41 The Contractor shall be in compliance with all applicable standards, orders, or requirements 42 issued under Section 306 of the Clear Air Act [42 U.S.C. 1857(h)], Section 508 of the Clean 43 Water Act (33 U.S.C. 1368), Executive Order 11738, and Environmental Protection Agency 44 Regulations (40 CFR Part 15). (Contracts, subcontracts, and subgrants of amounts in 45 excess of$100,000). 46 47 The Contractor shall comply with mandatory standards and policies relating to energy 48 efficiency which are contained in the State Energy Conservation Plan issued in compliance 49 with the Energy Policy and Conservation Act (Pub.
