I <br /> 1 The Contractor shall pay all associated costs of providing each Manufacturer's Certificate of <br /> 2 Compliance submitted for City acceptance. <br /> 3 <br /> 111 <br /> 4 The City reserves the right to refuse to accept Equipment on the basis of a Manufacturer's <br /> 5 Certificate of Compliance. <br /> 6 <br /> 7 Section 1-06.3(1) is added as follows: <br /> 8 <br /> 9 1-06.3(1) Inspection Point at Manufacturing <br /> 10 The Contractor shall be responsible to reimburse the City for the costs of inspections at the <br /> 11 point of manufacturing for inspections occurring outside of Whatcom, Skagit, Island, <br /> 12 Snohomish, King, Pierce and Thurston counties. Costs to be paid or reimbursed by the <br /> 13 Contractor include, but are not limited to, travel, subsistence, labor and lodging expenses of <br /> 14 the City Inspector. <br /> 15 <br /> 16 Point of manufacturing inspection will be required if: <br /> 17 <br /> 18 Inspection and testing of materials or Equipment in the vicinity of the Work by the City <br /> 19 is not practicable, <br /> 20 <br /> 21 The Contractor requests the City to inspect and test material or Equipment at the point <br /> 22 of manufacture, or <br /> 23 <br /> 24 The Standard Specifications or these Special Provisions require that inspection, testing <br /> 25 or witnessing of tests take place at the point of manufacture. <br /> 26 <br /> 27 1-06.4 Handling and Storing Materials <br /> 28 Supplement 1-06.4 by adding the following: <br /> 29 <br /> 30 The Contractor shall store materials and Equipment so as to insure the preservation of their <br /> 31 quality and fitness for the Work. Stored Equipment and materials shall be located so as to <br /> 32 facilitate inspection. The Contractor shall be responsible for damages, loss or casualty <br /> 33 occurring to materials and Equipment until Final Acceptance. <br /> 34 <br /> 35 <br /> 36 1-07 Legal Relations and Responsibilities to the Public <br /> 37 <br /> 38 1-07.1 Laws to be Observed <br /> 39 Section 1-07.1 is modified by adding the following: <br /> 40 <br /> 41 The Contractor shall be in compliance with all applicable standards, orders, or requirements <br /> 42 issued under Section 306 of the Clear Air Act [42 U.S.C. 1857(h)], Section 508 of the Clean <br /> 43 Water Act (33 U.S.C. 1368), Executive Order 11738, and Environmental Protection Agency <br /> 44 Regulations (40 CFR Part 15). (Contracts, subcontracts, and subgrants of amounts in <br /> 45 excess of$100,000). <br /> 46 <br /> 47 The Contractor shall comply with mandatory standards and policies relating to energy <br /> 48 efficiency which are contained in the State Energy Conservation Plan issued in compliance <br /> 49 with the Energy Policy and Conservation Act (Pub.
