FINAL DECLARATION OF N0N-SIC1;IFICANr- <br />11 <br />The }ioposed actinn is the issuance of gr-ding and building permits to allow the construction <br />of approximately 209,672 square feet of retail sales building to expand the existing Everett <br />Mall.. The proposal includes a drugstore of approximately 38,136 square feet; a major <br />department store with approximately 119,116 square feet; and .,iacellaneous retail shops of <br />�^ vy approximately 52,420 square feet. The following factors were considered prior to mikinc, a <br />0 ��I� preliminary decision on U,.is proposal: <br />�j <br />-I 1. The site is zoned C-1. Cencral Commercial Zone, which would allow the proposed use. The <br />q q development is an expansion of the existing Everett Mall retail shopping center on the site. <br />and would require build;^g permits for.each individual facilit, to be constructed. <br />2. A substantial portion of the area proposed for expansion has.been previously paved and <br />is currently used for parking or vehicle circulation. However, the southeastern portion <br />of the site is currently heavily wooded with Alder and scattered large Fir, and a stand .' <br />of Fir exists adjacent to I-5. This wooded area will he eliminated and replaced with <br />parking for the expanded mall area. <br />3. The existing Mall has a private drainage detention system. Increased runoff will. result <br />from the elimination of the wooded area and the additional impervious surface. Drainage <br />must he designated in conformance with tha City's Drainage -Ordinance. <br />4. The expanded Everett Mall will abut an existing and a proposed multiple family :esidential <br />area to the South. Adequate site screening and landscape buffer must be prov.'.ded between <br />the commercial and residential uses. Landscaping of parking areas must be -,fanned in <br />conformance with City Code. <br />5. Access to the Mall site is currently from three points on South Broadway on the north (with <br />connections from the Snohomish County P.U.D. improved right-of-way (ROW) on the west), and <br />from 100th Street on the southwest. The P.U.D. ROW is not a publicly dedicated street and <br />its use may be terminated upon notice from the P.U.D. The P.U.D. access is currently <br />poorly maintained. Traffic generated by 209,672 square feet of retail sales area will be <br />added to these streets. <br />The proposed expansion would generate an estimated 4,000 additional vehicle trips per day, <br />raising the total vehicle trips per day generated by the expanded Everett Mall to 25,000. <br />R <br />L ` The City's Street Improvement Ordinance #555-78 must be complied with. Access, circulation <br />and parking plans are to be submitted to the Public Works Department for review and approval. <br />-Plans are to include all abutting public right of way and show a-1 required public improvements <br />A list of specific traffic impact mitigating measures established by the City Traffic Engineer <br />are shown below and must be fully implemented by the applicant: <br />a) The applicant shall dedicate a 60 foot wide ROW to the City west of the Snohomish P1ID <br />ROW or immediately adjacent to the PUD ROW along its easterly boundary in a configura- <br />tion acceptable to the Public Works Director. This public ROW shall extend from <br />South Broadway to 100th Street and shall include any ROW necessary to insure a <br />continuous public road ROW (including a permanent easement across the PUD ROW) from <br />the existing 100th Street public ROW to thn internal driveway and circulation system <br />of the Mall. This dedication shall be completed prior to the issuance of building <br />permits for the project by the City. <br />b) The applicant shall convey a power of attorney for the creation of a Local Improvement <br />District (L.I.D.) for purposes of constructing public improvements to 100th Street, <br />7th Avenue S.E., South Broadway and the Public Right of Way (ROW) dedicated to the <br />City. Such power of attorney form shall be approved by the City Attorr.+-y and executed <br />and delivered prior to the issuance of any building permits. <br />c) The existing meter driveway on South Broadway shall be marked with four traffic lanes <br />according to standards established by the City Traffic Engineer. The applicant shall <br />also install a traffic control signal at this driveway intersection at his own expense. <br />The Public Works Director shall determine the type and design of the signal device to <br />be installed. This condition shall be complied with or a written agreement providing <br />for compliance with this condition shall to executed prior to issuance of a building <br />permit. <br />d) The applicant shall also be responsible for in:talling traffic control signals at the <br />westerly driveway on South Broadway and at suc, time as it is determined necessary <br />by the Public Works Director, at the southerly access point to the Mall either at <br />the PUD ROW or the newly dedicated public ROW. The Public Works Director shali <br />determine the type and design of the signal d•:;ices to be installed. This condition <br />shall be complied with or a written agreement providing for compliance with this <br />condition shall be executed prior to issuance of a building permit. <br />
